Patent Cooperation Treaty (PCT) Information For information concerning PCT member countries, see the notice appearing in the Official Gazette at 1342 O.G. 51, on May 12, 2009. European Patent Office as Searching and Examining Authority The European Patent Office (EPO) may act as the International Searching Authority (ISA) for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. However, the EPO is no longer a competent ISA, within the meaning of PCT Article 16(3), for international applications filed by U.S. residents or nationals on or after March 1, 2002, in the USPTO or IB as a Receiving Office, and where the application contains one or more claims directed to the field of business methods. For the definition of what the EPO considers to be precluded subject matter in the field of business methods, applicants should see the "Notice from the President of the European Patent Office", dated November 26, 2001, and which was published as Annex A in the "Notice Concerning EPO Competence to Act as PCT Authority" in the Official Gazette at 1255 O.G. 878, on February 19, 2002. The European Patent Office may act as the International Preliminary Examining Authority (IPEA) for an international application filed in the United States Receiving Office or the International Bureau as Receiving Office where at least one of the applicants is either a national or resident of the United States of America, provided that the European Patent Office acted as the International Searching Authority. However, the EPO is no longer a competent IPEA, within the meaning of PCT Article 32(3), for international applications filed by U.S. residents or nationals in the USPTO or IB as a Receiving Office where the corresponding demand is filed with the EPO on or after March 1, 2002, and where the application contains one or more claims directed to the field of business methods. The search fee of the European Patent Office was decreased, effective March 1, 2009, and was announced in the Official Gazette at 1339 O.G. 61, on February 17, 2009. Korean Intellectual Property Office as Searching and Examining Authority For use of the Korean Intellectual Property Office as an International Searching Authority and International Preliminary Examining Authority for international applications filed in the United States Receiving Office, see the notice appearing in the Official Gazette at 1302 O.G. 1261 on January 17, 2006. The search fee of the Korean Intellectual Property Office was increased, effective January 1, 2009, and was announced in the Official Gazette at 1338 O.G. 61, on January 13, 2009. States Receiving Office or the International Bureau as Receiving Office where at least one of the applicants is either a national or resident of the United States of America, provided that IP Australia acted as the International Searching Authority. The search fee of IP Australia was decreased, effective February 1, 2009, and was announced in the Official Gazette at 1339 O.G. 59, on February 10, 2009. Fees The transmittal fee and search fees for the USPTO were changed, effective January 12, 2009, and were announced in the Federal Register on November 12, 2008. The fee for filing a request for the restoration of the right of priority was established, effective November 9, 2007, and was announced in the Federal Register on September 10, 2007. International filing fees were increased, effective May 1, 2009, and were announced in the Official Gazette at 1340 O.G. 212, on March 31, 2009. Notice of Maintenance Fees Payable Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides that maintenance fees may be paid without surcharge for the six-month period beginning 3, 7, and 11 years after the date of issue of patents based on applications filed on or after Dec. 12, 1980. An additional six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e) for payment of the maintenance fee with the surcharge set forth in 37 CFR 1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is not paid in the patent requiring such payment the patent will expire on the 4th, 8th, or 12th anniversary of the grant. Attention is drawn to the patents that were issued on June 27, 2006 for which maintenance fees due at 3 years and six months may now be paid. Sequence Listings and Tables Related Thereto in International Applications Filed in the United States Receiving Office The Administrative Instructions (AIs) under the Patent Cooperation Treaty (PCT), in force as of July 1, 2009, contain important changes relating to the manner of filing, and applicable fees for, sequence listings and/or tables related thereto (sequence listings/tables) in international applications. The complete text may be accessed at http://www.wipo.int/pct/en/texts/index.htm. Effective July 1, 2009, Part 8 ("Instructions Relating To International Applications Containing Large Nucleotide And/Or Amino Acid Sequence Listings And/Or Tables Relating Thereto") and Annex C-bis ("Technical Requirements For The Presentation Of Tables Related To Nucleotide And Amino Acid Sequence Listings In International Patent Applications Under The PCT") will no longer form part of the AIs. Part 8 was introduced in 2001 as a temporary solution to problems arising from the filing of very large sequence listings on paper and provided for a sequence listing forming part of the international application to be filed in electronic form on physical medium (e.g., compact discs), together with the remainder of the application on paper. In 2002, Part 8 was expanded to include tables related to sequence listings and Annex C-bis was added to provide technical requirements. The capability to file complete international applications in electronic form is now available to all applicants, eliminating the need for these temporary provisions. Summary of Changes Related to Sequence Listings/Tables Effective July 1, 2009 I. AI Part 8 and Annex C-bis deleted; Fees under AI § 707 Sequence listings/tables forming part of the international application are no longer acceptable on an electronic medium as part of an international application on paper. Tables filed as a separate part of the description in text format compliant with former AI Annex C-bis are acceptable. Where an international application is filed in electronic form via EFS-Web, a sequence listing forming part of the international application under PCT Rule 5.2 must be filed in either Annex C/ST.25 text format, which is preferred, or in PDF format. Where the sequence listing forming part of the international application is filed in Annex C/ST.25 text format, no further copy of a sequence listing not forming part of the international application is necessary for search purposes under PCT Rule 13ter, and NO page fees will be assessed for the sequence listing in text format. Where the sequence listing forming part of the international application is foled in PDF format, an additional copy of a sequence listing not forming part of the international application in Annex C/ST.25 text format is necessary for search purposes under PCT Rule 13ter, and FULL page fees will be assessed for every page of the sequence listing in PDF format. Where the Annex C/ST.25 text format of a sequence listing is larger than the EFS-Web size limit of 100 megabytes, consistent with current practice, applicant may use EFS-Web to file part of the international application, obtain the international application number and the confirmation number, and submit the sequence listing on one or more compact discs using Express Mail from the United States Postal Service (USPS) in accordance with 37 CFR 1.10, or hand delivery, as appropriate, in order to secure the same filing date for all parts of the international application. Availability of Sequence Listings Provided for Search Purposes Effective July 1, 2009, AI § 513 enables the International Bureau to make available, through the PATENTSCOPE(r) Search Service (see http://www.wipo.int/patentscope/en/ for further information), any sequence listing not forming part of the international application provided for the purposes of international search (sequence listings forming part of the international application are already made available on PATENTSCOPE(r)). AI § 514(e) requires International Searching Authorities to transmit a copy of any such sequence listing in electronic form to the International Bureau. III. This information includes all issued patents, all registered trademarks, the Official Gazette of the U.S. Patent and Trademark Office, search tools such as the Cassis CD-ROM suite of products and supplemental information in a variety of formats including online, optical disc, microfilm and paper. The Electronic Official Gazette of the U.S. Patent and Trademark Office - Patents (eOG:P) provides the information contained in the paper version of the Official Gazette in electronic format on CD-ROM. Similar to the paper OG, the eOG:P is published every Tuesday and includes bibliographic information, a representative claim, and a drawing (if applicable) of each patent issued that week. Patents are accessible by type of patent (utility, plant, etc.), classification (class or class/subclass), patentee name, and geographical location. Links enable users to "jump" to a specific patent from these various indexes. The eOG:P is sold as an annual subscription or as single copies.
Subscriptions are $430.00 per year, with single copies available for $20.00. For single copy purchases, please specify date and volume/issue number. Order forms are available in MS Word® or Adobe® Acrobat® format.
