Patent Cooperation Treaty (PCT) Information For information concerning PCT member countries, see the notice appearing in the Official Gazette at 1342 O.G. 51, on May 12, 2009. European Patent Office as Searching and Examining Authority The European Patent Office (EPO) may act as the International Searching Authority (ISA) for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. However, the EPO is no longer a competent ISA, within the meaning of PCT Article 16(3), for international applications filed by U.S. residents or nationals on or after March 1, 2002, in the USPTO or IB as a Receiving Office, and where the application contains one or more claims directed to the field of business methods. For the definition of what the EPO considers to be precluded subject matter in the field of business methods, applicants should see the "Notice from the President of the European Patent Office", dated November 26, 2001, and which was published as Annex A in the "Notice Concerning EPO Competence to Act as PCT Authority" in the Official Gazette at 1255 O.G. 878, on February 19, 2002. The European Patent Office may act as the International Preliminary Examining Authority (IPEA) for an international application filed in the United States Receiving Office or the International Bureau as Receiving Office where at least one of the applicants is either a national or resident of the United States of America, provided that the European Patent Office acted as the International Searching Authority. However, the EPO is no longer a competent IPEA, within the meaning of PCT Article 32(3), for international applications filed by U.S. residents or nationals in the USPTO or IB as a Receiving Office where the corresponding demand is filed with the EPO on or after March 1, 2002, and where the application contains one or more claims directed to the field of business methods. The search fee of the European Patent Office was decreased, effective March 1, 2009, and was announced in the Official Gazette at 1339 O.G. 61, on February 17, 2009. Korean Intellectual Property Office as Searching and Examining Authority For use of the Korean Intellectual Property Office as an International Searching Authority and International Preliminary Examining Authority for international applications filed in the United States Receiving Office, see the notice appearing in the Official Gazette at 1302 O.G. 1261 on January 17, 2006. The search fee of the Korean Intellectual Property Office was increased, effective September 15, 2009, and was announced in the Official Gazette at 1345 O.G. 163, on August 25, 2009. Fees The transmittal fee and search fees for the USPTO were changed, effective January 12, 2009, and were announced in the Federal Register on November 12, 2008. The fee for filing a request for the restoration of the right of priority was established, effective November 9, 2007, and was announced in the Federal Register on September 10, 2007. International filing fees were increased, effective May 1, 2009, and were announced in the Official Gazette at 1340 O.G. 212, on March 31, 2009. Notice of Maintenance Fees Payable Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides that maintenance fees may be paid without surcharge for the six-month period beginning 3, 7, and 11 years after the date of issue of patents based on applications filed on or after Dec. 12, 1980. An additional six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e) for payment of the maintenance fee with the surcharge set forth in 37 CFR 1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is not paid in the patent requiring such payment the patent will expire on the 4th, 8th, or 12th anniversary of the grant. Clarification of the Date of Decision of the Board of Patent Appeals and Interferences Under 37 CFR 1.304 This notice clarifies that the date of decision of the Board of Patent Appeals and Interferences (BPAI) under 37 CFR 1.304 is the "mailing date" or "notification date" indicated on form PTOL-90 accompanying the BPAI decision. On July 31, 2009, the U.S. Court of Appeals for the Federal Circuit held that the date of decision of the BPAI under 37 CFR 1.304 is the mailing date of the decision rather than the date typed on the first page of the decision by the BPAI. In re McNeil-PPC, Inc., slip op. at 4-7 (Fed. Cir. July 31, 2009). On June 2, 2009, the Office expanded the e-Office Action program to permit all Private Patent Application Information Retrieval (PAIR) users to participate. See Electronic Office Action, 1343 Off. Gaz. Pat. Office, 45 (June 2, 2009). Under the e-Office Action program, participants receive notifications via electronic mail of the Office communications retrievable through Private PAIR in lieu of paper mailings of Office communications, with a few exceptions (e.g., reexamination proceedings and interference proceedings are not included in the program). The Official Gazette notice for the e-Office Action program stated that the two-month time period set forth in 37 CFR 1.304 is not measured from the mailroom/notification date, but instead is measured from the date typed on the first page of the decision by the BPAI. This statement is in error, in view of Federal Circuit McNeil decision, and is hereby withdrawn. This withdrawal will apply to BPAI decisions mailed before, on or after the publication date of this notice. Accordingly, the two-month time period set forth in 37 CFR 1.304 for filing a notice of appeal to the U.S. Court of Appeals for the Federal Circuit, or for commencing a civil action, starts on: (1) the mailing date of the BPAI decision if the decision is mailed to the appellant, or (2) the notification date of the BPAI decision if electronic mail notification is sent to the appellant under the e-Office Action program, as indicated on form PTOL-90 accompanying the BPAI decision. For example, a notice of appeal under 37 CFR 1.302 for an appeal of a decision by the BPAI to the U.S. Court of Appeals for the Federal Circuit filed within two months from the mailing date or notification date of the BPAI decision would be considered timely. Notice Concerning Calculation of the Patent Term Adjustment under 35 U.S.C. § 154(b)(1)(B) involving International Applications Entering the National Stage Pursuant to 35 U.S.C § 371 Summary: The computer program that the United States Patent and Trademark Office (USPTO) uses to calculate patent term adjustment incorrectly calculates the three-year pendency provision of 35 U.S.C. § 154(b)(1)(B) in international applications if the requirements of 35 U.S.C. § 371 are not fulfilled on the date that the national stage commenced under 35 U.S.C. § 371(b) or (f). The USPTO is in the process of correcting this computer program. Applicants seeking a revised patent term adjustment determination based on this calculation must submit a timely request for reconsideration of the patent term adjustment indicated in the patent under 37 CFR 1.705(d). Background: Under 35 U.S.C. § 154(b)(1)(B), an applicant is entitled to additional patent term adjustment if the issue of an original patent is delayed due to the failure of the USPTO to issue a patent within three years after the actual filing date of the application. The USPTO implemented the three-year pendency provision in 35 U.S.C. § 154(b)(1)(B) in 37 CFR 1.702(b) and 37 CFR 1.703(b). See Changes to Implement Patent Term Adjustment Under Twenty-Year Patent Term, 65 Fed. Reg. 56365, 56391-92 (Sept. 18, 2000) (final rule). The USPTO indicated the three-year pendency provision in 35 U.S.C. § 154(b)(1)(B) is measured from the date that the national stage commences under 35 U.S C. § 371(b) or (f) in an international application. See Changes to Implement Patent Term Adjustment Under Twenty-Year Patent Term, 65 Fed. Reg. at 56382-84. The USPTO makes patent term adjustment determinations by a computer program that uses the information recorded in the USPTO's automated patent application information system (the Patent Application Locating and Monitoring system or PALM system), except when an applicant requests reconsideration pursuant to 37 CFR 1.705. See Changes to Implement Patent Term Adjustment Under Twenty-Year Patent Term, 65 Fed. Reg. at 56370, 56380-81. Discussion: The USPTO is in the process of correcting an error in the computer program that it uses to calculate the patent term adjustment that affects patents issuing from international applications entering the national stage as to the United States pursuant to 35 U.S.C. § 371. The USPTO's computer program incorrectly calculates the three-year pendency provision of 35 U.S.C. § 154(b)(1)(B) in international applications as being measured from the date that the requirements of 35 U.S.C. § 371 were fulfilled rather than the date the national stage commenced under 35 U.S.C. § 371(b) or (f) in the international application. The USPTO is correcting the computer program to reflect that the three-year pendency provision of 35 U.S.C. § 154(b)(1)(B) in international applications is measured from the date the national stage commenced under 35 U.S.C. § 371(b) or (f) in the international application. An applicant seeking a revised patent term adjustment determination based upon the three-year pendency provision must submit a timely request for reconsideration of the patent term adjustment indicated in the patent. The USPTO does not calculate and inform the applicant of the patent term adjustment based upon the three-year pendency provision of 35 U.S.C. § 154(b)(1)(B) in the notice of allowance because the USPTO must know the date the patent will issue to be able to calculate the patent term adjustment based upon this provision. Thus, reconsideration of the patent term adjustment indicated in the patent as it relates to the three-year pendency provision of 35 U.S.C. § 154(b)(1)(B) is not considered a matter that could have been raised in an application for patent term adjustment under 37 CFR 1.705(b) (provides for reconsideration of the patent term adjustment indicated in the notice of allowance). The Electronic Official Gazette of the U.S. Patent and Trademark Office - Patents (eOG:P) provides the information contained in the paper version of the Official Gazette in electronic format on CD-ROM. Similar to the paper OG, the eOG:P is published every Tuesday and includes bibliographic information, a representative claim, and a drawing (if applicable) of each patent issued that week. Patents are accessible by type of patent (utility, plant, etc.), classification (class or class/subclass), patentee name, and geographical location. Links enable users to "jump" to a specific patent from these various indexes. The eOG:P is sold as an annual subscription or as single copies.
Subscriptions are $430.00 per year, with single copies available for $20.00. For single copy purchases, please specify date and volume/issue number. Order forms are available in MS Word® or Adobe® Acrobat® format.
