Patent Cooperation Treaty (PCT) Information For information concerning PCT member countries, see the notice appearing in the Official Gazette at 1350 O.G. 73, on January 12, 2010. For information on subject matter under Rule 39 that a particular International Searching Authority will not search, see Annex D of the PCT Applicants' Guide. European Patent Office as Searching and Examining Authority The European Patent Office (EPO) may act as the International Searching Authority (ISA) for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. However, the EPO is no longer a competent ISA, within the meaning of PCT Article 16(3), for international applications filed by U.S. residents or nationals on or after March 1, 2002, in the USPTO or IB as a Receiving Office, and where the application contains one or more claims directed to the field of business methods. For the definition of what the EPO considers to be precluded subject matter in the field of business methods, applicants should see the "Notice from the President of the European Patent Office", dated November 26, 2001, and which was published as Annex A in the "Notice Concerning EPO Competence to Act as PCT Authority" in the Official Gazette at 1255 O.G. 878, on February 19, 2002. The European Patent Office may act as the International Preliminary Examining Authority (IPEA) for an international application filed in the United States Receiving Office or the International Bureau as Receiving Office where at least one of the applicants is either a national or resident of the United States of America, provided that the European Patent Office acted as the International Searching Authority. However, the EPO is no longer a competent IPEA, within the meaning of PCT Article 32(3), for international applications filed by U.S. residents or nationals in the USPTO or IB as a Receiving Office where the corresponding demand is filed with the EPO on or after March 1, 2002, and where the application contains one or more claims directed to the field of business methods. The search fee of the European Patent Office was increased, effective January 1, 2010, and was announced in the Official Gazette at 1350 O.G. 72, on January 12, 2010. Korean Intellectual Property Office as Searching and Examining Authority For use of the Korean Intellectual Property Office as an International Searching Authority and International Preliminary Examining Authority for international applications filed in the United States Receiving Office, see the notice appearing in the Official Gazette at 1302 O.G. 1261 on January 17, 2006. The search fee of the Korean Intellectual Property Office was increased, effective January 1, 2010, and was announced in the Official Gazette at 1350 O.G. 72, on January 12, 2010. Fees The transmittal fee and search fees for the USPTO were changed, effective January 12, 2009, and were announced in the Federal Register on November 12, 2008. The fee for filing a request for the restoration of the right of priority was established, effective November 9, 2007, and was announced in the Federal Register on September 10, 2007. International filing fees were increased, effective January 1, 2010, and were announced in the Official Gazette at 1350 O.G. 72, on January 12, 2010. Notice of Maintenance Fees Payable Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides that maintenance fees may be paid without surcharge for the six-month period beginning 3, 7, and 11 years after the date of issue of patents based on applications filed on or after Dec. 12, 1980. An additional six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e) for payment of the maintenance fee with the surcharge set forth in 37 CFR 1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is not paid in the patent requiring such payment the patent will expire on the 4th, 8th, or 12th anniversary of the grant. Attention is drawn to the patents that were issued on March 20, 2007 for which maintenance fees due at 3 years and six months may now be paid. Mr. Rowe was disbarred for violating Texas Disciplinary Rules of Professional Conduct, Rules 1.01(b)(1), 1.04(a), 1.06(b)(2), 8.04(a)(3), and 8.04(a)(11) predicated upon: (1) after being appointed as the Independent Executor for a decedent's estate, Mr. Rowe hired himself as attorney to represent the estate even though he was administratively suspended from the practice of law; (2) he hired himself as attorney to represent the estate under an agreement giving himself a legal fee of one-third the estate value as a flat fee for legal services; (3) as attorney for the Independent Executor, Mr. Rowe failed to file an Inventory and Appraisement of the estate until after the probate court entered a rule to show cause; (4) based on Mr. Rowe's advice, the estate invested funds with another of his clients; the client who receive the investment funds owed Mr. Rowe legal fees of two-hundred thousand dollars ($200,000); and Mr. Rowe refused to disclose the terms of the investment; (5) the interests of the Independent Executor and the client who received the investment funds were adverse to each other and adverse to Mr. Rowe's interests; and (6) Mr. Rowe, as Independent Executor, paid himself a ninety-six thousand dollar ($96,000) fee, which was determined to be an unconscionable and grossly excessive fee by the tribunal that removed him as Independent Executor. This action is taken pursuant to the provisions of 35 U.S.C. §§ 2(b)(2)(D) and 32, and 37 C.F.R. § 11.24. Notice of Stayed Suspension Lawrence J. Gibney of Jacksonville, Florida, a registered patent attorney (Registration Number 49,062). The United States Patent and Trademark Office has suspended Mr. Gibney for six months, with the entirety of the suspension stayed, and placed him on probation for twenty-four (24) months for: violating 37 C.F.R. §§ 10.68(a)(1) by accepting compensation from one other than the practitioner's client for the practitioner's legal service to or for the client without first receiving the client's consent after full disclosure; 10.62(a) by accepting employment without first receiving the consent of the client after full disclosure under circumstances where the exercise of the practitioner's professional judgment on behalf of the client will be or reasonably may be affected by the practitioner's own financial, business, property, or personal interests; 10.23(b)(6) by taking action on the client's behalf without the client's knowledge or consent and failing to inform the client on a timely basis of such actions; and 10.112 (a) and (b) by commingling client funds with his firm's business funds. Mr. Gibney is permitted to practice before the Office during his probation unless the stay of the suspension is lifted. Mr. Gibney received two referrals from an invention development company and accepted the representations and subsequent compensation from the company without first obtaining the referred clients' consent after full disclosure to accept compensation from a third party for patent legal services he intended to provide to the clients. Mr. Gibney also accepted the representation without divulging his business relationship with the company to the clients as well as the actual or potential conflict of interest it presented in representing the clients' interests in light of the business relationship. Moreover, with respect to one of the referrals, Mr. Gibney did not adequately consult with the client prior to taking action on the client's behalf or keep the client timely informed of the actions taken. Finally, Mr. Gibney received an $895.00 check from one client for patent law services and filing fees and placed the check in his firm's operating account rather than in a client trust account as required by the USPTO Disciplinary Rules. Where a third party receives funds advanced by a practitioner's client and intends to distribute part of those funds to the practitioner as compensation for the practitioner's patent legal services to or for the client, the USPTO Disciplinary Rules requires a practitioner to obtain the client's consent after full disclosure of the arrangement. See 37 C.F.R. § 10.68(a)(1). In order to meet the "full disclosure" requirement, the practitioner should make inquiry from both the third party and the client about the funds being collected and distributed for the practitioner's compensation. Absent such inquiry, the practitioner may fail to recognize an impending violation of a Disciplinary Rule such as 37 C.F.R. § 10.48, which proscribes sharing legal fees with a non-practitioner. For example, where a practitioner receives referrals and compensation from a third party, such as an invention development company, the practitioner's inquiry of both the third party and the client about the funds being collected and the amount of the funds to be distributed for the practitioner's compensation may be necessary to avoid a possible violation of § 10.48 because, if (a) the third party is not a practitioner and (b) the entire amount received by the third party for the practitioner's compensation is not distributed to the practitioner and any undistributed compensation funds being held by the third party is not returned to the client, then, in effect, the practitioner may be sharing compensation with a non-practitioner in violation of the USPTO Disciplinary Rules. Furthermore, concomitant with making such inquiry, in order to represent zealously the client's interests, the practitioner should communicat with the client to ensure that the client is aware that a non-practitioner third party is typically not obligated by USPTO Disciplinary Rules to refund unearned legal fees maintained in the third party's escrow account, whereas the practitioner is obligated by those

rules to refund to the client unearned legal fees in the practitioner's possession. See 37 C.F.R. §§ 10.40(a) and 10.112(c)(4). Also, where a practitioner's livelihood is predicated in some measure upon regularly receiving referrals and compensation from a third party, the USPTO Disciplinary Rules require a practitioner, prior to accepting employment, to obtain the consent of the client after full disclosure, if the exercise of the practitioner's professional judgment on behalf of the client will be, or reasonably may be, affected by the practitioner's own financial, business, property, or personal interests. See 37 C.F.R. § 10.62(a). Absent a frank and meaningful discussion that fully informs the client of the actual and potential conflicts of interest arising from the referral, the client would likely be unable to provide the requisite consent thereby subjecting the practitioner to potential disciplinary action. This action is the result of a settlement agreement between Mr. Gibney and the OED Director pursuant to the provisions of 35 U.S.C. §§ 2(b)(2)(D) and 32, and 37 C.F.R. §§ 11.20, 11.26 and 11.59. This information includes all issued patents, all registered trademarks, the Official Gazette of the U.S. Patent and Trademark Office, search tools such as the Cassis CD-ROM suite of products and supplemental information in a variety of formats including online, optical disc, microfilm and paper. Each PTDL also offers access to USPTO resources on the Internet and to PubWEST (Web based examiner search tool), a system used by patent examiners that is not available on the Internet. The Electronic Official Gazette of the U.S. Patent and Trademark Office - Patents (eOG:P) provides the information in electronic format on CD-ROM. The eOG:P is published every Tuesday and includes bibliographic information, a representative claim, and a drawing (if applicable) of each patent issued that week. Patents are accessible by type of patent (utility, plant, etc.), classification (class or class/subclass), patentee name, and geographical location. Links enable users to "jump" to a specific patent from these various indexes. The eOG:P is sold as an annual subscription or as single copies.
Subscriptions are $430.00 per year, with single copies available for $20.00. For single copy purchases, please specify date and volume/issue number. Order forms are available in MS Word® or Adobe® Acrobat® format.
