European Patent Office as Searching and Examining Authority
The European Patent Office (EPO) may act as the International Searching
Authority (ISA) for an international application filed with the United
States Receiving Office or the International Bureau (IB) as Receiving
Office where at least one of the applicants is either a national or
resident of the United States of America. However, the EPO is no longer
a competent ISA, within the meaning of PCT Article 16(3), for
international applications filed by U.S. residents or nationals on or
after March 1, 2002, in the USPTO or IB as a Receiving Office, and where
the application contains one or more claims directed to the field of
business methods. For the definition of what the EPO considers to be
precluded subject matter in the field of business methods, applicants
should see the "Notice from the President of the European Patent
Office", dated November 26, 2001, and which was published as Annex A in
the "Notice Concerning EPO Competence to Act as PCT Authority" in
the Official Gazette at 1255 O.G. 878, on February 19, 2002.
The European Patent Office may act as the International Preliminary
Examining Authority (IPEA) for an international application filed in the
United States Receiving Office or the International Bureau as Receiving
Office where at least one of the applicants is either a national or
resident of the United States of America, provided that the European
Patent Office acted as the International Searching Authority. However,
the EPO is no longer a competent IPEA, within the meaning of PCT Article
32(3), for international applications filed by U.S. residents or nationals
in the USPTO or IB as a Receiving Office where the corresponding demand is
filed with the EPO on or after March 1, 2002, and where the application
contains one or more claims directed to the field of business methods.
The search fee of the European Patent Office was decreased, effective
September 15, 2010, and was announced in the Official Gazette at 1357 O.G.
135, on August 17, 2010.
Korean Intellectual Property Office as Searching and Examining Authority
For use of the Korean Intellectual Property Office as an International
Searching Authority and International Preliminary Examining Authority for
international applications filed in the United States Receiving Office,
see the notice appearing in the Official Gazette at 1302 O.G. 1261 on
January 17, 2006.
The search fee of the Korean Intellectual Property Office was increased,
effective January 1, 2010, and was announced in the Official Gazette at
1350 O.G. 72, on January 12, 2010.
Australian Patent Office as Searching and Examining Authority
The Australian Patent Office (IP Australia) may act as the International
Searching Authority (ISA) for an international application filed with the
United States Receiving Office or the International Bureau (IB) as
Receiving Office where at least one of the applicants is either a national
or resident of the United States of America. However, IP Australia is not a
competent ISA, within the meaning of PCT Artical 16(3), for international
applications filed by U.S. residents or nationals in the USPTO or IB as a
Receiving Office, and where the application contains one or more claims

IP Australia may act as the International Preliminary Examining
Authority (IPEA) for an international application filed in the United
States Receiving Office or the International Bureau as Receiving Office
where at least one of the applicants is either a national or resident of
the United States of America, provided that IP Australia acted as the
International Searching Authority. However, IP Australia is not a competent
IPEA, within the meaning of PCT Article 32(3), for international
applications filed by U.S. residents or nationals in the USPTO or IB as a
Receiving Office where the corresponding demand is filed with IP Australia
and where the application contains one or more claims directed to the
fields of business methods or mechanical engineering or analogous fields of
technology as defined by specified areas of the International Patent
Classification System, as indicated in Annex A to the agreement between the
USPTO and IP Australia. See the notice appearing in the Official Gazette

The search fee of IP Australia was increased, effective August 1, 2010,
and was announced in the Official Gazette at 1357 O.G. 135, on August 17,
2010.
Fees
The transmittal fee and search fees for the USPTO were changed,
effective January 12, 2009, and were announced in the Federal Register on
November 12, 2008. The fee for filing a request for the restoration of the
right of priority was established, effective November 9, 2007, and was
announced in the Federal Register on September 10, 2007.
International filing fees were decreased, effective September 1, 2010, and
were announced in the Official Gazette at 1357 O.G. 135, on August 17, 2010.

Notice of Maintenance Fees Payable
Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides
that maintenance fees may be paid without surcharge for the six-month
period beginning 3, 7, and 11 years after the date of issue of patents
based on applications filed on or after Dec. 12, 1980. An additional
six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e)
for payment of the maintenance fee with the surcharge set forth in 37 CFR
1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is
not paid in the patent requiring such payment the patent will expire on
the 4th, 8th, or 12th anniversary of the grant.
Attention is drawn to the patents that were issued on Oct. 2, 2007
for which maintenance fees due at 3 years and six months may now be paid.

35 U.S.C. 41 and 37 CFR 1.362(g) provide that if the required
maintenance fee and any applicable surcharge are not paid in a patent

Preface
On May 4, 2010, the following two documents requesting an interim
suspension of, and initiating a disciplinary action against, Dean J.
Tricarico were filed with the Director of the United States Patent and
Trademark Office: (i) a Request for Notice, Order, Interim Suspension, and
Referral for Further Proceedings Pursuant to 37 C.F.R. § 11.25 and (ii) a
Disciplinary Complaint Pursuant to 35 U.S.C. § 32 and 37 C.F.R. § 11.25.
Via a June 1, 2010, Service by Publication appearing in the June 22 and
June 29, 2010, editions of the Official Gazette, Mr. Tricarico was duly
served with (i) the Request for Notice, Order, Interim Suspension, and
Referral for Further Proceedings Pursuant to 37 C.F.R. § 11.25 and (ii) the
Disciplinary Complaint Pursuant to 35 U.S.C. § 32 and 37 C.F.R. § 11.25.

On August 27, 2010, a Notice and Order Pursuant to 37 C.F.R. § 11.25
("Notice and Order") was issued and, in accordance with 37 C.F.R. §§ 11.25(b)
and 11.35, the following documents were attempted to be served on
Mr. Tricarico by first-class certified mail, return receipt requested, to a
street address in Carlsbad, California, which was the most recent address
provided by Mr. Tricarico to the Office of Enrollment and Discipline pursuant
to 37 C.F.R. § 11.11, and to a street address in Winchester, Virginia, where
it was reasonably believed that Mr. Tricarico received mail: (i) the Notice
and Order, (ii) the Request for Notice, Order, Interim Suspension, and
Referral for Further Proceedings Pursuant to 37 C.F.R. § 11.25, (iii) the
Disciplinary Complaint Pursuant to 35 U.S.C. § 32 and 37 C.F.R. § 11.25, and
(iv) copies of a certified copy of records from Commonwealth of Virginia v.
Dean James Tricarico (Case Nos. CR08001108-00 and CR08001107-00).
The mailing to the Carlsbad, California, address was returned with the
explanation that it was "Undeliverable as Addressed," and the mailing to the
Winchester, Virginia, address was returned with the explanation "Moved.
Left no address. Unable to forward."
Mr. Tricarico is hereby notified through this publication that he may
obtain a copy of: (i) the Notice and Order, (ii) the Request for Notice,
Order, Interim Suspension, and Referral for Further Proceedings Pursuant to

between the USPTO and EPO
On September 29, 2008, the United States Patent and Trademark Office
(USPTO) commenced a Patent Prosecution Highway pilot program (PPH) which
enabled an applicant whose claims have been determined allowable/patentable
in an application filed in the European Patent Office (EPO) to have the
corresponding application filed in the USPTO advanced out of turn for
examination. See notice entitled "Patent Prosecution Highway Pilot Program
between the United States Patent and Trademark Office and European Patent
Office," 1335 Off. Gaz. Pat. Office 196 (October 21, 2008). The PPH pilot
program was originally scheduled to end on September 29, 2009.
The USPTO and EPO agreed to extend the PPH pilot program for one year
ending on September 30, 2010. See notice entitled "Continuation of the Patent
Prosecution Highway Pilot Program between the USPTO and EPO," 1347 Off. Gaz.
Pat. Office 170 (October 20, 2009). In order to adequately assess the
feasibility of the PPH pilot program, the USPTO and EPO have agreed to
continue to extend the pilot until January 28, 2012, to collect more
information before any formal decision on the program is made.

SUMMARY: The United States Patent and Trademark Office (USPTO) is seeking
public assistance in providing technical training to patent examiners within
all technology centers. The Patent Examiner Technical Training Program
(PETTP) is intended to provide scientists and experts as lecturers to patent
examiners in order to update them on technical developments, the state of the
art, emerging trends, maturing technologies, and recent innovations in their
fields. Such guest lecturers must have relevant technical knowledge, as well
as familiarity with prior art and industry practices/standards in areas of
technology where such lectures would be beneficial.

prior art and industry practices/standards in areas of technology where such
lectures would be beneficial. The Patent Examiner Technical Training Program
is not intended as an opportunity for applicants to discuss pending
applications or to circumvent normal communication between applicants or
applicants' representatives and examiners or Supervisory Patent Examiners.
In addition, Patent Examiner Technical Training Program participants are not
to provide advice or recommendations to the USPTO. The Patent Examiner
Technical Training Program is envisioned as an opportunity to provide patent
examiners with necessary training from scientists and experts working
directly in the various technologies throughout the USPTO. It is anticipated
that lectures will last approximately two hours.
All participants in the Patent Examiner Technical Training Program must
agree to serve without compensation and must fund their own expenses,
including, but not limited to: travel to and from the USPTO, meals, and
lodging arrangements. Webinars are an option for participants who elect not
to travel. All offers for technical training made to the program will be
tracked in a database to ensure that all offers for technical training are
addressed. The USPTO reserves the right to refuse any request to participate
in the program. Among other factors, whether a request to participate in the
program is granted will depend on the appropriateness of the topic and the
availability of resources. For granted requests, audience size will vary. If
a participant is not satisfied with the program, the participant may contact
Wynn Coggins, TC 3600 Director, who is overseeing the program.
The Patent Examiner Technical Training Program will be in effect as of the
date noted above until further notice.

Technical Training Program, participants must fill in and submit the on-line
form available at http://frwebgate.access.gpo.gov/cgi-bin/leaving.cgi?from=

send an e-mail to Examiner_Technical_Training@uspto.gov identifying the area
of technical assistance that they can provide, their name and phone number,
and other contact information as necessary. Once a participant fills in and
submits the on-line form or sends the e-mail, the participant will receive a
system generated e-mail response noting that the inquiry was received.
The participant thereafter should expect a telephone call from the point
of contact within the specified area identified for technical assistance.
During this initial telephone call, the participant will be informed of USPTO
invited speaker requirements pursuant to Agency Administrative Order (AAO)
219-05. Also, the target audience will be identified and possible dates for
the event discussed.
Prior to giving a presentation, all PETTP participants must sign the
USPTO's Invited Speaker Conflict of Interest Policy Statement. In addition,
PETTP presentations are sometimes recorded and made available to employees
for viewing or listening at a later time. The Invited Speaker Conflict of

SUMMARY: The United States Patent and Trademark Office (USPTO) is
considering pro-business strategies for incentivizing the development
and widespread distribution of technologies that address humanitarian
needs. One proposal being considered is a fast-track ex parte
reexamination voucher pilot program to create incentives for
technologies and licensing behavior that address humanitarian needs.
Because patents under reexamination are often the most commercially
significant patents, a fast-track reexamination proceeding would allow
patent owners to more readily and less expensively affirm the validity
of their patents. Therefore, the opportunity to utilize a voucher for a
fast-track reexamination proceeding could provide a valuable incentive
for entities to pursue humanitarian technologies or licensing. The
USPTO is requesting comments from the public regarding this proposal as
well as other incentive proposals set forth in this notice.
DATES: Comment Deadline Date: To be ensured of consideration, written
comments must be received on or before November 19, 2010. No public hearing
will be held.

creation or licensing that addresses humanitarian needs. Under the proposed
pilot program, a fast-track ex parte reexamination voucher would be offered
to patent holders demonstrating humanitarian uses of patented technologies.
This voucher could then be used on any patent owned by the patent holder or
transferred on the open market. The U.S. Food and Drug Administration (FDA)
currently has a similar voucher program for fast-track review in place. Under

this program, the FDA awards priority review vouchers to entities that
develop drugs to treat neglected tropical diseases. Recent legislative
proposals such as the Creating Hope Act, S. 3697 (2010), on rare childhood
diseases shows a desire on the part of Congress to expand such efforts. The
USPTO is also exploring ideas for other strategies that would use the patent
system to incentivize activity addressing humanitarian needs.
Fast-track ex parte reexamination proceedings would be given the highest
priority, such that an examiner would take any necessary action in a
reexamination proceeding as if the proceeding were the next item in the
examiner's queue. In addition, the USPTO would accelerate the time for
which fast-track ex parte reexamination proceedings are handled by the USPTO
(i.e., examiner and the Board of Patent Appeals and Interferences (BPAI)).
The USPTO's goal for this time would be six months. The patent owner would
not be required to waive any current statutory and procedural rights, and
would have the same time periods for filing responses and other communications
as those under the existing procedure. The six-month goal would only measure
the time periods that the USPTO takes for actions (e.g., from the date of
filing of a response to the date of mailing of the action), excluding the
time that the patent owner takes for responding to an action. This goal
compares to the current 19 to 20-month period that the USPTO takes for action in
ex parte reexamination based on a review of 100 certificates issued between
June 15, 2010, and July 31, 2010.
In the pilot program, a fast-track ex parte reexamination voucher would be
offered to patent holders demonstrating humanitarian practices with patented
technologies as described below. Specifically, organizations may be eligible
for the program if they engage in intellectual property practices that qualify
as either humanitarian use or humanitarian research.
``Humanitarian use'' would comprise four principles: subject matter,
effectiveness, availability, and access. In general terms, subject matter
evaluates whether the patented technology addresses a recognized
humanitarian problem. Effectiveness judges whether the technology can be used
or is being used to address that issue. Availability determines whether the
technology is available to an affected impoverished population. Access
evaluates whether the applicant has made significant efforts to increase
access to the technology among such populations. The USPTO seeks to develop a
workable test to apply these principles that is clear, concise,
administratively efficient, and resistant to abuse.
"Humanitarian research" would comprise two principles: significance and
access. Significance requires that the patented technology make a significant
contribution to research on a problem that predominantly affects an
impoverished population, such as the tropical diseases identified by the FDA
in its priority review voucher scheme. Access determines that the patented
technology was made available to researchers on generous terms. The USPTO
seeks to develop a workable test to apply these principles which is clear,
concise, administratively efficient, and resistant to abuse.
Comments on one or more of the following questions would be helpful
to the USPTO:
1. The FDA awards priority review vouchers to entities that develop
drugs which treat a tropical disease under 21 U.S.C. 360n. Should
recipients of this FDA voucher automatically receive a humanitarian
fast-track ex parte reexamination voucher from the USPTO?
2. FDA priority review vouchers are transferable on the open market.
Should USPTO fast-track ex parte reexamination vouchers similarly be
transferable on the open market?
3. What humanitarian issues should qualify for the voucher program?
Neglected diseases, debilitating health conditions in developing countries,
chronic hunger, widespread public health problems such as lack of
sanitation or potable water, and/or other issues predominantly affecting

impoverished populations? Can these be defined with reference to existing
humanitarian aid organizations?
4. Other than actual use, how can a patent owner demonstrate that a
patented technology would be effective at addressing a particular
humanitarian issue? What kinds of expertise would be required to make
those judgments?
5. Should the USPTO consider statements from independent third parties
(particularly humanitarian organizations or researchers) on the
effectiveness or actual use of an invention to address humanitarian needs?
Should such submissions be required to qualify for a voucher?
6. Should certain elements (e.g., neglected diseases, tropical crops,
developing countries) of qualifying humanitarian criteria be defined with
reference to lists or criteria provided by external organizations experienced
in such matters, such as the World Health Organization, National Institutes
of Health, Food and Drug Administration, United Nations, or U.S. Agency for
International Development? If so, which criteria of other public or private
organizations should be followed?
7. What actions should be considered to determine whether a patent holder
has made significant efforts to increase access to a patented technology?
What types of evidence of such actions can be submitted to minimize the
burden on both patent owners and the USPTO?
8. How should a patented technology's significance to a humanitarian
research project be determined? Should significance mean that the research
could or would not have occurred without the use of the patented technology?
Would considering economic or logistical factors suffice? Should qualifying
research efforts meet certain minimum thresholds (resources, number of
researchers involved, involvement from recognized humanitarian groups, etc.)
to prevent abuse?
9. For the humanitarian research qualification, what factors should
determine whether terms of use are generous? Should it only focus on the cost of
the patented technology or consider other factors? What if the granting
entity retains any rights over the results of the humanitarian research?
10. How can the program encompass humanitarian issues affecting
impoverished populations in more developed countries in a way that is
efficient to administer and deters abuse? In particular, how should an
applicant demonstrate the existence of an impoverished group and that
the product or treatment primarily targets that group?
11. Should vouchers to accelerate initial examination rather than
reexamination be offered for technologies addressing humanitarian needs? Are
there other pro-business strategies that the Department of Commerce or the
USPTO should pursue in future programs to incentivize humanitarian research
and development and/or best practices for intellectual property with
humanitarian uses?
12. Would non-monetary prizes or awards sponsored by the USPTO recognizing
humanitarian efforts encourage greater investment in the field? What criteria
should be used for selecting recipients?

Libraries (PTDLs), provide public access to patent and trademark
information received from the United States Patent and Trademark Office
(USPTO). This information includes all issued patents, all registered
trademarks, the Official Gazette of the U.S. Patent and Trademark Office,
search tools such as the Cassis CD-ROM suite of products and supplemental
information in a variety of formats including online, optical disc,
microfilm and paper. Each PTDL also offers access to USPTO resources on
the Internet and to PubWEST (Web based examiner search tool), a system
used by patent examiners that is not available on the Internet.
Staff assistance and training is provided in the use of this information.
All information is available free of charge. However, there may be charges
associated with the use of photocopying and related services. Hours of

The eOG:P is published every Tuesday and includes bibliographic information, a representative claim, and a drawing (if applicable) of each patent
issued that week. Patents are accessible by type of patent (utility, plant, etc.), classification (class or class/subclass), patentee name, and
geographical location. Links enable users to "jump" to a specific patent from these various indexes. The eOG:P is sold as an annual subscription
or as single copies.
Subscriptions are $430.00 per year, with single copies available for $20.00. For single copy purchases, please specify date and volume/issue number. Order
forms are available in MS Word® or Adobe® Acrobat® format.
