Patent Cooperation Treaty (PCT) Information For information concerning PCT member countries, see the notice appearing in the Official Gazette at 1369 O.G. 5, on August 2, 2011. For information on subject matter under Rule 39 that a particular International Searching Authority will not search, see Annex D of the PCT Applicants' Guide. European Patent Office as Searching and Examining Authority The European Patent Office (EPO) may act as the International Searching Authority (ISA) or the International Preliminary Examining Authority (IPEA) for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. However, the use of the EPO is restricted. The EPO will not act as an ISA for applications with one or more claims directed to a business method. For the definition of what the EPO considers to be precluded subject matter in the field of business methods, see PCT Applicants's Guide, Annexes D(EP), E(EP) and the Official Notices (PCT Gazette) dated May 6, 2010, page 94 (http://www.wipo.int/pct/en/official_notices/index.html). The EPO will act as an IPEA only if it also acted as the ISA. The search fee of the European Patent Office was increased, effective April 1, 2012, and was announced in the Official Gazette at 1377 O.G. 5, on April 3, 2012. Korean Intellectual Property Office as Searching and Examining Authority The Korean Intellectual Property Office may act as the ISA or the IPEA for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. The announcement appears in the Official Gazette at 1302 O.G. 1261 on January 17, 2006. The search fee of the Korean Intellectual Property Office was decreased, effective January 1, 2012, and was announced in the Official Gazette at 1373 O.G. 177, on December 27, 2011. Australian Patent Office as Searching and Examining Authority The Australian Patent Office (IP Australia) may act as the ISA or the IPEA for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. The announcement appears in the Offical Gazette at 1337 O.G. 265, on December 23, 2008. However, the use of IP Australia is restricted. IP Australia will not act as an ISA for applications with one or more claims directed to the fields of business methods or mechanical engineering or analogous fields of technology as defined by specified areas of the International Patent Classification System, as indicated in the Official Gazette at 1337 O.G. 261 on December 23, 2008, in Annex A to the agreement between the USPTO and IP Australia, IP Australia will act as an IPEA only if it also acted as the ISA. The search fee of IP Australia was increased, effective May 1, 2012, and was announced in the Official Gazette at 1378 O.G. 5, on May 1, 2012. Notice of Maintenance Fees Payable Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides that maintenance fees may be paid without surcharge for the six-month period beginning 3, 7, and 11 years after the date of issue of patents based on applications filed on or after Dec. 12, 1980. An additional six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e) for payment of the maintenance fee with the surcharge set forth in 37 CFR 1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is not paid in the patent requiring such payment the patent will expire on the 4th, 8th, or 12th anniversary of the grant. Notice of Suspension This notice concerns Francis H. Lewis, Jr. of Daly City, California, a registered patent attorney (Registration Number 27,684) licensed to practice law in the State of California. In a reciprocal disciplinary proceeding, Mr. Lewis has been suspended for two years from the practice of patent, trademark, and other non-patent law and placed on probation for two years by the United States Patent and Trademark Office ("USPTO") for violating 37 C.F.R. § 10.23(b)(6) via 37 C.F.R. § 10.23(c)(5) by having been suspended on ethical grounds by a duly constituted authority of the State of California. After completing a minimum of nine months of his USPTO suspension and making restitution to two clients, Mr. Lewis may request reinstatement pursuant to 37 C.F.R. § 11.60. If reinstated, Mr. Lewis will be permitted to practice patent law, and trademark and non-patent law provided he satisfies 37 C.F.R. § 11.14(a), before the USPTO during his probationary period, provided he is not subsequently suspended or excluded from practice before the Office. Via a July 8, 2011 order, the Supreme Court of California in In re Francis Hotchkiss Lewis, Jr., Case No. S192797, suspended Mr. Lewis for two years, stayed that suspension, placed him on a two-year probation, and suspended him for a minimum of the first nine months of his probation and until he makes restitution to two clients. The discipline was predicated upon a determination that Mr. Lewis violated the following California Rules of Professional Conduct: rule 3-310(C)(1) by representing three clients without their informed written consent, in a landlord-tenant matter, when the interests of the clients potentially conflicted; rule 3-310(D) by representing three clients and entering into an aggregate settlement of the claims of the clients, without the informed written consent of each client; rule 4-100(B)(3) by failing to render appropriate accounts to a client; rule 4-100(B)(4) by failing to promptly resolve a dispute with his clients before disbursing funds to himself; and rule 4-100(A) when Respondent's client trust funds account balance fell below the value of the balance of settlement funds he was holding in trust for clients. Further, the discipline was predicated on a determination that Mr. Lewis violated California Business and Professions Code § 6106 by misappropriating at least $7,687.84 of his client's funds. Via a January 24, 2012 order, the Supreme Court of California in In re David Gillespie Malveaux, Case No. S198032, suspended Mr. Malveaux for three years, stayed that suspension, placed him on a four-year probation, and suspended him for ninety days of his probation. The discipline was predicated upon two State Bar Court matters, Nos. 10-O-00685 and 11-O-12879. Regarding Case No. 10-O-685, it was stipulated that on December 21, 2009, Respondent faxed to the State Bar a three-page medical report for evaluation of substance abuse in connection with a then pending disciplinary proceeding, No. 07-C-13122; however, Respondent misrepresented to the State Bar that the report had been prepared by a particular doctor. By submitting the medical report which was not authored by the doctor to the State Bar and representing to the State Bar that the report had been prepared by that doctor, Respondent committed an act involving moral turpitude, dishonesty, or corruption in willful violation of Business and Professions Code section 6106. Regarding Case No. 11-O-12879, on May 20, 2012, the Supreme Court of California had issued a disciplinary order to resolve four prior State Bar matters, placing Respondent on a two-year stayed suspension with conditions, including a three-year probation; however, Respondent failed to comply with the quarterly reporting conditions and the substance abuse conditions of his disciplinary probation. By failing to timely comply with the quarterly reporting conditions and the substance abuse conditions of his disciplinary probation imposed by the Supreme Court Order, Respondent failed to comply with all conditions attached to a disciplinary probation in willful violation of Business and Professions Code section 6068(k). Portner of Jupiter, Florida, an attorney licensed in Florida and authorized to represent others before the United States Patent and Trademark Office ("USPTO") in trademark and non-patent matters. In a reciprocal disciplinary proceeding, the USPTO Director ordered that Mr. Portner be publicly reprimanded by the USPTO for violating 37 C.F.R. § 10.23(b)(6) when he was publicly reprimanded by the Supreme Court of Florida. Mr. Portner is not a registered patent practitioner and is not authorized to practice patent law before the USPTO. In Florida Bar v. Henry Neil Portner, Case No. SC 10-288 (Fla. Aug 19, 2010), the Supreme Court of Florida publicly reprimanded Mr. Portner. The public reprimand was predicated upon a determination that Mr. Portner disseminated or caused to be disseminated a direct mail advertisement for foreclosure defense and loan modification representation on various occasions in 2009. Statements in the direct mail advertisement were misleading; the advertisement lacked the necessary language stating that "If you have already retained a lawyer for this matter, please disregard this letter;" failed to disclose how respondent obtained the intended recipient's name and address; lacked the name of the lawyer responsible for the content of the advertisement; the trade name listed in the advertisement was misleading; and the advertisement was not timely filed for review either before or simultaneously with the dissemination of the advertisement to the public as required. Reference Collections of U.S. Patents Available for Public Use in Patent and Trademark Resource Centers The following libraries, designated as Patent and Trademark Resource Centers (PTRCs), provide public access to patent and trademark information received from the United States Patent and Trademark Office (USPTO). This information includes all issued patents, all registered trademarks, the Official Gazette of the U.S. Patent and Trademark Office, search tools such as the Cassis CD-ROM suite of products and supplemental information in a variety of formats including online, optical disc, microfilm and paper. Each PTRC also offers access to USPTO resources on the Internet and to PubWEST (Web based examiner search tool), a system used by patent examiners that is not available on the Internet. Staff assistance and training is provided in the use of this information. All information is available free of charge. However, there may be charges associated with the use of photocopying and related services.
