Patent Cooperation Treaty (PCT) Information For information concerning PCT member countries, see the notice appearing in the Official Gazette at 1369 O.G. 5, on August 2, 2011. For information on subject matter under Rule 39 that a particular International Searching Authority will not search, see Annex D of the PCT Applicants' Guide. European Patent Office as Searching and Examining Authority The European Patent Office (EPO) may act as the International Searching Authority (ISA) or the International Preliminary Examining Authority (IPEA) for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. However, the use of the EPO is restricted. The EPO will not act as an ISA for applications with one or more claims directed to a business method. For the definition of what the EPO considers to be precluded subject matter in the field of business methods, see PCT Applicants's Guide, Annexes D(EP), E(EP) and the Official Notices (PCT Gazette) dated May 6, 2010, page 94 (http://www.wipo.int/pct/en/official_notices/index.html). The EPO will act as an IPEA only if it also acted as the ISA. The search fee of the European Patent Office was increased, effective April 1, 2012, and was announced in the Official Gazette at 1377 O.G. 5, on April 3, 2012. Korean Intellectual Property Office as Searching and Examining Authority The Korean Intellectual Property Office may act as the ISA or the IPEA for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. The announcement appears in the Official Gazette at 1302 O.G. 1261 on January 17, 2006. The search fee of the Korean Intellectual Property Office was decreased, effective January 1, 2012, and was announced in the Official Gazette at 1373 O.G. 177, on December 27, 2011. Australian Patent Office as Searching and Examining Authority The Australian Patent Office (IP Australia) may act as the ISA or the IPEA for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. The announcement appears in the Offical Gazette at 1337 O.G. 265, on December 23, 2008. However, the use of IP Australia is restricted. IP Australia will not act as an ISA for applications with one or more claims directed to the fields of business methods or mechanical engineering or analogous fields of technology as defined by specified areas of the International Patent Classification System, as indicated in the Official Gazette at 1337 O.G. 261 on December 23, 2008, in Annex A to the agreement between the USPTO and IP Australia, IP Australia will act as an IPEA only if it also acted as the ISA. The search fee of IP Australia was increased, effective May 1, 2012, and was announced in the Official Gazette at 1378 O.G. 5, on May 1, 2012. An additional six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e) for payment of the maintenance fee with the surcharge set forth in 37 CFR 1.20(h), as amended effective Dec. 16, 1991. Notice of Suspension This concerns Hugh D. Jaeger of Wayzata, Minnesota, an attorney licensed in Minnesota and Pennsylvania and registered to practice before the United States Patent and Trademark Office (USPTO) (Registration Number 27,270). In a reciprocal disciplinary proceeding, the Director of the USPTO has ordered that Mr. Jaeger be suspended for a minimum of 120 days. After serving the 120 day suspension, he may request reinstatement pursuant to 37 C.F.R. § 11.60 for the sole purpose of being placed on voluntary inactive status consistent with 37 C.F.R. § 11.11(d). Mr Jaeger shall not be permitted to be restored to active status on the register after serving the 120 day suspension. Mr. Jaeger violated 37 C.F.R. § 10.23(b)(6) via 37 C.F.R. § 10.23(c)(5) when he was disciplined by the Supreme Court of Minnesota in In re Petition for Disciplinary Action against Hugh D. Jaeger, a Minnesota Attorney, Registration No. 49529, Case No. A11-0182 (MN. Aug. 11. 2011). The discipline was predicated upon a determination that Mr. Jaeger violated Minnesota Rules of Professional Conduct 1.3, 1.15(c)(4), 1.16(d), 4.1, 8.1(b), and 8.4(c), and Rule 25 of the Rules of Lawyers Professional Responsibility by neglecting multiple client matters, signing documents without consent, failing to return client files, and failing to cooperate with the disciplinary investigation. In its August 11, 2011 Order, the Supreme Court of Minnesota indefinitely suspended Mr. Jaeger for a minimum of 120 days and ordered that he be reinstated to inactive status (retired) following the end of his suspension period; that he not apply for reinstatement to the active practice of law in Minnesota; and that he not apply for admission to the bar (or reinstatement, if applicable) in any other jurisdiction. This action is taken pursuant to the provisions of 35 U.S.C. § 32 and 37 C.F.R. §§ 11.24 and 11.59. DEPARTMENT OF COMMERCE Patent and Trademark Office [Docket No. PTO-P-2012-0025] Extension of the Full First Action Interview Pilot Program and Request for Comments AGENCY: United States Patent and Trademark Office, Commerce. ACTION: Notice and request for comments. SUMMARY: The United States Patent and Trademark Office (Office) is extending the First Action Interview (FAI) Pilot Program while completing a comprehensive review of the program, deciding what, if any, adjustments should be made to the program, and whether the program should be extended further or made permanent. The program is intended to expedite disposition of an application by enhancing communication between an applicant and an examiner at the beginning of the examination process. Specifically, the program allows an applicant to conduct an interview with an examiner prior to the issuance of an Office action, but after receiving the examiner's search results and initially identified issues. During its review, the Office will consider feedback from both internal and external stakeholders. Accordingly, in addition to announcing the extension of the program, the Office is requesting comments on the program. DATES: Comment Deadline Date: Written comments must be received on or before August 8, 2012. No public hearing will be held. Extension Date: The Office has extended the FAI Pilot Program until August 16, 2012. Notice of this extension was placed on the USPTO's Web site just after expiration of the prior extension. examiner after reviewing a Pre-Interview Communication providing the results of a prior art search conducted by the examiner. Since the date the pilot was expanded, the Office has received over 2,100 requests to participate in the program. Of the applications that have been taken up for examination since the expansion, the Office has allowed over 35% on first action. Participants in the program have experienced several benefits including: (1) Effectively advancing prosecution of an application before issuance of an Office action; (2) enhanced interaction between the applicant and the examiner before issuance of an Office action; (3) resolving patentability issues one-on-one with the examiner at the beginning of the prosecution process, rather than after a first Office action; and (4) expedited allowance of an application, relative to standard examination, due to the program's enhanced communication and shorter time periods for response. Extension: The Office is extending the FAI Pilot Program until August 16, 2012, while it completes its evaluation of the program. During this time, the Office will be gathering and analyzing relevant information, including comments from external and internal participants in order to determine what, if any, adjustments should be made to the program and whether the program will become permanent or be further extended. Request for Comments: The Office is seeking comments on the FAI Pilot Program. The Office is interested in receiving feedback as to whether the program is meeting the needs of its applicants, and whether any aspects of the program cause applicants to not participate. The following questions have been provided to help elicit the types of information the Office is interested in receiving. However, the list of questions below is not exhaustive and responses do not need to be limited to only information that answers these questions. (1) Based on your use of the program, did you experience the benefits of the FAI program set out above? Did you experience additional benefits? (2) Did the Pre-Interview Communication provide you with sufficient, meaningful information to conduct an effective interview? (3) How productive is the interview before first action in advancing prosecution? (4) How would you rate the extent/utility of the information provided in the Pre-Interview Communication and subsequent Office action? (5) What changes would you make to the FAI program? How would these changes improve the program? (6) For any application in which you decided that the FAI program would not meet your needs, what aspect of the program made the program unsuitable for the application? Reference Collections of U.S. Patents Available for Public Use in Patent and Trademark Resource Centers The following libraries, designated as Patent and Trademark Resource Centers (PTRCs), provide public access to patent and trademark information received from the United States Patent and Trademark Office (USPTO). This information includes all issued patents, all registered trademarks, the Official Gazette of the U.S. Patent and Trademark Office, search tools such as the Cassis CD-ROM suite of products and supplemental information in a variety of formats including online, optical disc, microfilm and paper. Each PTRC also offers access to USPTO resources on the Internet and to PubWEST (Web based examiner search tool), a system used by patent examiners that is not available on the Internet. Staff assistance and training is provided in the use of this information. All information is available free of charge. However, there may be charges associated with the use of photocopying and related services.
