Patent Cooperation Treaty (PCT) Information For information concerning PCT member countries, see the notice appearing in the Official Gazette at 1369 O.G. 5, on August 2, 2011. For information on subject matter under Rule 39 that a particular International Searching Authority will not search, see Annex D of the PCT Applicants' Guide. European Patent Office as Searching and Examining Authority The European Patent Office (EPO) may act as the International Searching Authority (ISA) or the International Preliminary Examining Authority (IPEA) for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. However, the use of the EPO is restricted. The EPO will not act as an ISA for applications with one or more claims directed to a business method. For the definition of what the EPO considers to be precluded subject matter in the field of business methods, see PCT Applicants's Guide, Annexes D(EP), E(EP) and the Official Notices (PCT Gazette) dated May 6, 2010, page 94 (http://www.wipo.int/pct/en/official_notices/index.html). The EPO will act as an IPEA only if it also acted as the ISA. The search fee of the European Patent Office was increased, effective April 1, 2012, and was announced in the Official Gazette at 1377 O.G. 5, on April 3, 2012. Korean Intellectual Property Office as Searching and Examining Authority The Korean Intellectual Property Office may act as the ISA or the IPEA for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. The announcement appears in the Official Gazette at 1302 O.G. 1261 on January 17, 2006. The search fee of the Korean Intellectual Property Office was decreased, effective January 1, 2012, and was announced in the Official Gazette at 1373 O.G. 177, on December 27, 2011. Australian Patent Office as Searching and Examining Authority The Australian Patent Office (IP Australia) may act as the ISA or the IPEA for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. The announcement appears in the Offical Gazette at 1337 O.G. 265, on December 23, 2008. However, the use of IP Australia is restricted. IP Australia will not act as an ISA for applications with one or more claims directed to the fields of business methods or mechanical engineering or analogous fields of technology as defined by specified areas of the International Patent Classification System, as indicated in the Official Gazette at 1337 O.G. 261 on December 23, 2008, in Annex A to the agreement between the USPTO and IP Australia, IP Australia will act as an IPEA only if it also acted as the ISA. The search fee of IP Australia was increased, effective May 1, 2012, and was announced in the Official Gazette at 1378 O.G. 5, on May 1, 2012. An additional six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e) for payment of the maintenance fee with the surcharge set forth in 37 CFR 1.20(h), as amended effective Dec. 16, 1991. Continuation of the Patent Prosecution Highway Pilot Program between the USPTO and IP Australia based on Patent Cooperation Treaty Work Products On January 24, 2011, the United States Patent and Trademark Office (USPTO) commenced a Patent Prosecution Highway pilot program based on Patent Cooperation Treaty (PCT) work products (PCT-PPH pilot program) with IP Australia (IPAU). The PCT-PPH pilot program enabled an applicant who has received a written opinion or an international preliminary examination report from IPAU as the International Searching Authority (ISA) or International Preliminary Examining Authority (IPEA) indicating that at least one claim in the PCT application has novelty, inventive step and industrial applicability to have the corresponding application filed in the USPTO be advanced out of turn for examination. See notice entitled "Patent Prosecution Highway Pilot Program between the United States Patent and Trademark Office and IP Australia based on Patent Cooperation Treaty Work Products," 1363 Off. Gaz. Pat. Office 105 (February 15, 2011). The USPTO indicated that the PCT-PPH pilot program would terminate on April 13, 2012, but could be extended for an additional time period thereafter. In order to adequately assess the feasibility of the PCT-PPH pilot program, the USPTO and IPAU have agreed to collect more information before any final decision on the program is made. The pilot has been extended indefinitely. Patent Prosecution Highway Pilot Program between the United States Patent and Trademark Office and the Israeli Patent Office based on Patent Cooperation Treaty Work Products |
Since 2006, the United States Patent and Trademark Office (USPTO) has established Patent Prosecution Highway (PPH) pilot programs with several offices, including the Israeli Patent Office (ILPO). In general, such PPH pilot programs permit an applicant who receives a determination from one office that at least one claim is allowable/patentable to request that a corresponding application in another office be accorded special status and advanced out of turn for examination. These PPH pilot programs are limited to the utilization of search and examination results of national applications between cross filings under the Paris Convention.
In order to expand the potential of the PPH program, the USPTO implemented new PPH pilot programs with various offices based on Patent Cooperation Treaty (PCT) work products. The USPTO had discussions with the ILPO to launch a similar PPH pilot program based on PCT work products (PCT-PPH pilot program). The USPTO and the ILPO agreed that consistency between PCT-PPH pilot programs should be maintained to the extent possible, to avoid creating burdens on applicants and offices, and to ensure maximum work sharing potential.
The PCT-PPH pilot program was established to enable an applicant, who has received
(1) a Written Opinion from an International Searching Authority (WO/ISA) (ISA must be the ILPO or the USPTO), or
(2) a Written Opinion from an International Preliminary Examining Authority (WO/IPEA) (IPEA must be the ILPO or the USPTO), or
(3) an International Preliminary Examination Report (IPER) from an International Preliminary Examining Authority (IPEA must be the ILPO or the USPTO), that indicates at least one claim in the PCT application has novelty, inventive step and industrial applicability, to file a request to participate in the PCT-PPH pilot program in a corresponding U.S. application and petition to make the U.S. application special under the PCT-PPH pilot program. Note that the procedures for a petition to make special under the accelerated examination program set forth in MPEP 708.02(a) do NOT apply to a petition to make special under the PCT-PPH pilot program. The procedures and requirements for filing a request in the USPTO for participation in the PCT-PPH pilot program are set forth below.
The USPTO and the ILPO agreed that the PCT-PPH pilot program will commence on August 1, 2012, for a period of one year ending on July 31, 2013. The trial period may be extended if necessary to adequately assess the feasibility of the PCT-PPH pilot program. The USPTO and the ILPO may also terminate the PCT-PPH pilot program early if the volume of participation exceeds a manageable level, or for any other reasons. Notice will be published if the PCT-PPH pilot program will be terminated before July 31, 2013.
In order to be eligible to participate in the PCT-PPH pilot program, the following conditions must be met:
(1) The relationship between the corresponding U.S. application for which participation in the PCT-PPH pilot program is requested and the PCT application satisfies one of the following requirements (note that RO/-- as used in the diagrams below refers to an international application filed under the PCT in any competent receiving office):
(a) The U.S. application is a national stage entry of the corresponding PCT application. See diagrams (A), (A’) and (A”) below.
(b) The U.S. application is a national application which forms the basis for the priority claim in the corresponding PCT application. See diagram (B) below. Provisional applications, plant applications, design applications, reissue applications and applications subject to a secrecy order (35 U.S.C. 181) are excluded and not subject to participation in the PCT-PPH pilot program.
(c) The U.S. application is a national stage entry of another PCT application (which can be filed in any competent receiving office) which claims priority to the corresponding PCT application. See diagram (C) below.
(d) The U.S. application is a national application claiming foreign/domestic priority to the corresponding PCT application. See diagram (D) below. Provisional applications, plant applications, design applications, reissue applications and applications subject to a secrecy order (35 U.S.C. 181) are excluded and not subject to participation in the PCT-PPH pilot program.
(e) The U.S. application is a continuing application (continuation, divisional, or continuation-in-part) of the U.S. application which satisfies one of the above (a) through (d) scenarios. See diagrams (E1) and (E2) below. Provisional applications, plant applications, design applications, reissue applications and applications subject to a secrecy order (35 U.S.C. 181) are excluded and not subject to participation in the PCT-PPH pilot program.

In diagram (E2), US2 application may be a non-provisional application claiming benefit under 35 U.S.C. 119(e) to a provisional application (US1).
(2) The latest work product in the international phase of the PCT application corresponding to the U.S. application, namely, the WO/ISA, WO/IPEA, or the IPER, indicates at least one claim in the PCT application has novelty, inventive step and industrial applicability. In case any observation is described in Box VIII of the WO/ISA, WO/IPEA, or IPER which forms the basis for the PCT-PPH request, applicant must identify and explain why the claim(s) is/are not subject to any observation described in Box VIII irrespective of whether an amendment is submitted to correct the observation described in Box VIII. The U.S. application will not be eligible to participate in the PCT-PPH pilot program if applicant does not identify and explain why the claim(s) is/are not subject to the observation described in Box VIII.
Note that the ISA and the IPEA which produced the WO/ISA, WO/IPEA and the IPER are limited to the ILPO or the USPTO.
Applicant may not file a request to participate in the PCT-PPH pilot program on the basis of an International Search Report (ISR) only.
(3) Claim Correspondence
(a) All of the claims in each U.S. application for which a request for participation in the PCT-PPH pilot program is made must sufficiently correspond to or be amended to sufficiently correspond to one or more of those claims indicated as having novelty, inventive step and industrial applicability and be free of any observation described in Box VIII in the latest work product of the corresponding PCT application. (b) Claims are considered to “sufficiently correspond” where, accounting for differences due to translations and claim format requirements, the claims in the U.S. application are of the same or similar scope as the claims indicated as having novelty, inventive step and industrial applicability and free of any observation described in Box VIII in the latest work product of the corresponding PCT application, or the claims in the U.S. application are narrower in scope than the claims indicated as having novelty, inventive step and industrial applicability and free of any observation described in Box VIII in the latest work product of the corresponding PCT application. (c) In this regard, a claim that is narrower in scope occurs when a claim indicated as having novelty, inventive step and industrial applicability and free of any observation described in Box VIII in the latest work product of the corresponding PCT application is amended to be further limited by an additional feature that is supported in the written description of the U.S. application. The claim(s) with the narrower scope must be written in dependent form in the U.S. application for which participation in the PCT-PPH pilot program is requested. |
(4) Substantive examination of the U.S. application for which participation in the PCT-PPH pilot program is requested has not begun.
(5) Applicant must file a request for participation in the PCT-PPH pilot program and a request that the U.S. application be advanced out of turn for examination by order of the Director to expedite the business of the Office under 37 CFR 1.102(a). A sample request form (PTO/SB/20PCT-IL) will be available from the USPTO Web site at http://www.uspto.gov/forms/ on August 1, 2012. Applicants are encouraged to use the USPTO request form. A petition fee under 37 CFR 1.17(h) is NOT required. See Notice Regarding the Elimination of the Fee for Petitions To Make Special Filed Under the Patent Prosecution Highway (PPH) Programs, 75 FR 29312 (May 25, 2010).
(6) Unless already filed in the U.S. application for which participation in the PCT-PPH pilot program is requested, applicant must submit a copy of the latest international work product, WO/ISA, WO/IPEA or IPER, which indicated that the claim(s) has/have novelty, inventive step and industrial applicability along with an English translation thereof if the copy of the latest international work product is not in the English language. A statement that the English translation is accurate is not required. Where the required documents have been previously filed in the U.S. application, applicant may simply refer to these documents and indicate in the request for participation in the PCT-PPH pilot program when these documents were previously filed in the U.S. application. Where the U.S. application and the corresponding PCT application satisfy the relationship noted in B.(1)(a) above, applicant need not submit a copy of the latest international work product along with an English translation thereof since a copy of these documents is already contained in the file wrapper of the U.S. application.
(7) Unless already filed in the U.S. application for which participation in the PCT-PPH pilot program is requested, applicant must submit a copy of the claims from the corresponding PCT application which were indicated as having novelty, inventive step and industrial applicability in the latest work product of the PCT application along with an English translation thereof and a statement that the English translation is accurate if the claims are not in the English language. Where the required documents have been previously filed in the U.S. application, applicant may simply refer to these documents and indicate in the request for participation in the PCT-PPH pilot program when these documents were previously filed in the U.S. application. If the claims in the U.S. application for which participation in the PCT-PPH pilot program is requested are identical to the claims from the corresponding PCT application, and are in the English language, applicant may just indicate such in the PCT-PPH request and it will not be necessary for applicant to submit a copy of the claims from the corresponding PCT application.
(8) Applicant is required to submit a claims correspondence table in English. The claims correspondence table must indicate how all the claims in the U.S. application sufficiently correspond to the claims indicated as having novelty, inventive step and industrial applicability in the latest international work product.
(9) Applicant must submit an information disclosure statement (IDS) listing the documents cited in the international work products (ISR, WO/ISA, WO/IPEA, IPER) of the PCT application corresponding to the U.S. application for which participation in the PCT-PPH pilot program is requested (unless such an IDS has already been filed in the U.S. application, in which case applicant may simply refer to the previously filed IDS and indicate in the request for participation in the PCT-PPH pilot program when the IDS was previously filed in the U.S. application). Applicant must submit copies of all the documents cited in the international work products of the PCT application corresponding to the U.S. application (unless the copies have already been filed in the U.S. application, in which case applicant may simply refer to the previously filed copies of the documents and indicate in the request for participation in the PCT-PPH pilot program when the copies were previously filed in the U.S. application) except U.S. patents or U.S. patent application publications.
(10) The request for participation in the PCT-PPH pilot program and all the supporting documents must be submitted to the USPTO via EFS-Web and indexed with the following document description: “Petition to make special under PCT-Patent Pros Hwy.” Information regarding EFS-Web is available at http://www.uspto.gov/patents/process/file/efs/. Any preliminary amendments and IDS submitted with the PCT-PPH documents must be separately indexed as a preliminary amendment and IDS, respectively.
Where the request for participation in the PCT-PPH pilot program and special status are granted, applicant will be notified and the U.S. application will be advanced out of turn for examination. In those instances where the request for participation in the PCT-PPH pilot program does not meet all the requirements set forth above, applicant will be notified and the defects in the request will be identified. Applicant will be given one opportunity to perfect the request in a renewed request for participation (which must be submitted via EFS-Web and indexed accordingly as noted above). Note that action on the application by the examiner will NOT be suspended (37 CFR 1.103) awaiting a reply by the applicant to perfect the request in a renewed request for participation. That is, if the application is picked up for examination by the examiner after applicant has been notified of the defects in the request, any renewed request will be dismissed. If the renewed request is perfected and examination has not begun, the request and special status will be granted, applicant will be notified and the U.S. application will be advanced out of turn for examination. If not perfected, applicant will be notified and the application will await action in its regular turn.
Request for participation in the PCT-PPH pilot program and special status granted in a parent application will not carry over to a continuing application. Applicant must fulfill all the conditions set forth above in order for special status to be granted in the continuing application.
Once the request for participation in the PCT-PPH pilot program and special status have been granted to the U.S. application, the U.S. application will be taken up for examination by the U.S. examiner before all other categories of applications except those clearly in condition for allowance, those with set time limits, such as examiner’s answers, and those that have been granted special status for “accelerated examination.”
Any claims amended or added after the grant of the request for participation in the PCT-PPH pilot program must “sufficiently correspond” to the claims indicated as having novelty, inventive step and industrial applicability in the latest work product of the corresponding PCT application. See the definition of “sufficient correspondence” in II.B.(3) above. Applicant is required to submit a claims correspondence table along with the amendment (see II.B.(8) above). If the amended or newly added claims do not sufficiently correspond to the claims indicated as having novelty, inventive step and industrial applicability in the latest work product of the corresponding PCT application, the amendment will not be entered and will be treated as a non-responsive reply.
The PCT-PPH program does not absolve applicants of all their duties under 37 CFR 1.56 and 37 CFR 11.18. By complying with requirements II.B.(6) and (9) identified above, applicants would be considered to have complied with their duties to bring to the attention of the USPTO any material prior art cited in the corresponding PCT application (see MPEP § 2001.06(a)). Applicants still have a duty of candor and good faith, including providing to the USPTO other information known to them to be material to patentability.

Notice Regarding Full Implementation of Patent Prosecution Highway Program between the United States Patent and Trademark Office and the Israeli Patent Office |
Since July 1, 2011, the United States Patent and Trademark Office (USPTO) has conducted a Patent Prosecution Highway (PPH) pilot program with the Israeli Patent Office (ILPO). For a complete description of the PPH pilot program, see “Patent Prosecution Highway Pilot Program between the United States Patent and Trademark Office and the Israeli Patent Office,” 1368 Off. Gaz. Pat. Office 47 (July 5, 2011). The results of the pilot program showed that (1) applicants have been able to expeditiously obtain a patent in the Office of second filing (OSF) at an early stage, by utilizing the petition to make special procedures currently available in the OSF, based on claims that have been allowed in the Office of first filing (OFF); (2) the OSF has been able to reduce duplication of search efforts by exploiting the search and examination results of the OFF to the extent practicable; and (3) the OSF has been able to reduce the examination workload since the scope of the claims in the OSF application has been clarified through the OFF’s examination prosecution.
The USPTO and the ILPO agreed to fully implement the PPH program on a permanent basis starting on July 1, 2012. While the program itself will become a permanent cooperative arrangement between the offices, the specific program requirements are subject to change in the future depending on further development and evolution of the PPH. Notice of any such changes to the program will be published.
Note that the procedures for a petition to make special under the accelerated examination program set forth in MPEP 708.02(a) do NOT apply to a PPH request for expedited examination by order of the Director to expedite the business of the Office under 37 CFR 1.102(a). The procedures and requirements for filing a request in the USPTO for participation in the PPH program are set forth below.

The IL application whose claims are determined to be allowable/patentable does not have to be the application for which priority is claimed in the U.S. application (the basic application). The IL application can be an application explicitly derived from the basic application (e.g., a divisional application of the basic application). Note that where the IL application that contains the allowable/patentable claims is not the same application for which priority is claimed in the U.S. application, the applicant must identify the relationship between the IL application that contains the allowable/patentable claims and the IL priority application claimed in the U.S. application (e.g., IL application X that contains the allowable/patentable claims is a divisional application of IL application Y, which is the priority application claimed in the U.S. application).
Provisional applications, plant applications, design applications, reissue applications, reexamination proceedings, and applications subject to a secrecy order are excluded and not subject to participation in the PPH.
(2) The IL application(s) have at least one claim that was determined by the ILPO to be allowable/patentable in a substantive examination carried out in the name of the ILPO. The applicant must submit a copy of the allowable/patentable claims from the IL application(s) along with an English translation thereof and a statement that the English translation is accurate if the claims are not in the English language. If the ILPO office action does not explicitly state that a particular claim is allowable, the applicant must include a statement in the request for participation in the PPH program or in the transmittal letter accompanying the request for participation that no rejection has been made in the ILPO office action regarding that claim, and therefore, the claim is deemed allowable by the ILPO.
(3) All the claims in each U.S. application for which a request for participation in the PPH program is made must sufficiently correspond or be amended to sufficiently correspond to the allowable/patentable claims in the IL application(s). A claim is considered to "sufficiently correspond" where, accounting for differences due to translations and claim format, the claim in the U.S. application is of the same or similar scope as a claim indicated as allowable in the application filed in the ILPO. A claim in the U.S. application which is narrower in scope than the claims indicated as allowable in the application filed in the ILPO will also sufficiently correspond if presented as a claim dependent upon a claim which is of the same or similar scope as a claim indicated as allowable in the application filed in the ILPO. The additional limitation that makes the claim in the U.S. application narrower in scope than the allowable/patentable claims in the application filed in the ILPO must have support in the written description of the U.S. application.
The applicant is required to submit a claims correspondence table in English. The claims correspondence table must indicate how all the claims in the U.S. application correspond to the allowable/patentable claims in the application(s) filed in the ILPO. Any dependent claims with additional limitations must be clearly identified in the claims correspondence table.
(4) Examination of the U.S. application for which participation in the PPH program is requested has not begun.
(5) The applicant must file a request for participation in the PPH program and a request that the U.S. application be advanced out of turn for examination by order of the Director to expedite the business of the Office under 37 CFR 1.102(a). A sample request/petition form (PTO/SB/20IL) is available from the USPTO Web site at http://www.uspto.gov/forms/. Applicants are encouraged to use the USPTO request/petition form. A petition fee under 37 CFR 1.17(h) is NOT required. See Notice Regarding the Elimination of the Fee for Petitions To Make Special Filed Under the Patent Prosecution Highway (PPH) Programs, 75 Fed. (6) The applicant must submit a copy of all the office actions (which are relevant to patentability) from each of the IL application(s) containing the allowable/patentable claims that are the basis for the request, along with an English translation thereof and a statement that the English translation is accurate if the office actions are not in the English language. In addition, the applicant must submit copies of any office actions (which are relevant to patentability) from the IL application(s) issued after the grant of the request for participation in the PPH program in the USPTO (especially where the ILPO might have reversed a prior holding of allowability).
(7) The applicant must submit an information disclosure statement (IDS) listing the documents cited by the ILPO examiner in the ILPO office action (unless such an IDS has already been filed in the U.S. application). The applicant must submit copies of all the documents cited in the ILPO office action (unless the copies have already been filed in the U.S. application) except U.S. patents or U.S. patent application publications.

Once the request for participation in the PPH program and special status have been granted to the U.S. application, the U.S. application will be taken up for examination by the U.S. examiner before all other categories of applications except those clearly in condition for allowance, those with set time limits, such as examiner’s answers, and those that have been granted special status for “accelerated examination.”
Any claims amended or added after the grant of the request for participation in the PPH program must sufficiently correspond to one or more allowable/patentable claims in the IL application(s). The applicant is required to submit a claims correspondence table along with the amendment (see A.(3) above). If the amended or newly added claims do not sufficiently correspond to the allowable/patentable claims in the IL application(s), the amendment will not be entered and will be treated as a non-responsive reply.
The PPH program does not absolve applicants of all their duties under 37 CFR 1.56 and 37 CFR 11.18. By complying with requirements A.(6) and (7) identified above, applicants would be considered to have complied with their duties to bring to the attention of the USPTO any material prior art cited in the corresponding foreign application(s) (see MPEP § 2001.06(a)). Applicants still have a duty of candor and good faith, including providing to the USPTO other information known to them to be material to patentability.

Reference Collections of U.S. Patents Available for Public Use in Patent and Trademark Resource Centers The following libraries, designated as Patent and Trademark Resource Centers (PTRCs), provide public access to patent and trademark information received from the United States Patent and Trademark Office (USPTO). This information includes all issued patents, all registered trademarks, the Official Gazette of the U.S. Patent and Trademark Office, search tools such as the Cassis CD-ROM suite of products and supplemental information in a variety of formats including online, optical disc, microfilm and paper. Each PTRC also offers access to USPTO resources on the Internet and to PubWEST (Web based examiner search tool), a system used by patent examiners that is not available on the Internet. Staff assistance and training is provided in the use of this information. All information is available free of charge. However, there may be charges associated with the use of photocopying and related services.
