                  Patent Cooperation Treaty (PCT) Information

   For information concerning PCT member countries, see the notice
appearing in the Official Gazette at 1393 O.G. 61, on August 13, 2013.

   For information on subject matter under Rule 39 that a particular
International Searching Authority will not search, see Annex D of the PCT
Applicants' Guide.

European Patent Office as Searching and Examining Authority

   The European Patent Office (EPO) may act as the International Searching
Authority (ISA) or the International Preliminary Examining Authority (IPEA)
for an international application filed with the United States Receiving
Office or the International Bureau (IB) as Receiving Office where at least
one of the applicants is either a national or resident of the United States
of America. The EPO, effective January 1, 2015, no longer has any
limitations concerning its competency to act as an ISA. The announcement
appears in the Official Gazette at 1412 O.G. 61 on March 10, 2015.
Previously, the EPO would not act as an ISA and would not carry out an
international search for any application which contained one or more claims
relating to the field of business methods. As of January 1, 2015, U.S.
applicants filing their international applications with the USPTO or the IB
as receiving Office may select the EPO to act as the ISA without
restrictions. In applications containing claims relating to business
methods where the subject matter of the application also contains technical
features, the EPO will perform a search for those parts of the application
which are more than mere business methods. However, the EPO will issue a
declaration under PCT Rule 17(2)(a) that no ISR will be established
whenever an application relates only to a business method as such. The EPO
will act as an IPEA only if it also acted as the ISA.

   The search fee of the European Patent Office was changed, effective
January 1, 2016, and was announced in the Official Gazette at 1421
O.G. 246, on December 29, 2015.

Korean Intellectual Property Office as Searching and Examining Authority

   The Korean Intellectual Property Office may act as the ISA or the IPEA
for an international application filed with the United States Receiving
Office or the International Bureau (IB) as Receiving Office where at least
one of the applicants is either a national or resident of the United States
of America. The announcement appears in the Official Gazette at 1302 O.G.
1261 on January 17, 2006.

   The search fee of the Korean Intellectual Property Office was changed,
effective January 1, 2016, and was announced in the Official Gazette at
1421 O.G. 246, on December 29, 2015.

Australian Patent Office as Searching and Examining Authority

   The Australian Patent Office (IP Australia) may act as the ISA or the
IPEA for an international application filed with the United States
Receiving Office or the International Bureau (IB) as Receiving Office where
at least one of the applicants is either a national or resident of the
United States of America. The announcement appears in the Official Gazette
at 1337 O.G. 265, on December 23, 2008. However, the use of IP Australia is
restricted. IP Australia will not act as an ISA if it has received more
than 250 international applications from the USPTO during a fiscal quarter,
as indicated in the Official Gazette at 1409 O.G. 302 on December 30, 2014.
IP Australia will act as an IPEA only if it also acted as the ISA.

   The search fee of IP Australia was changed, effective January 1, 2016,
and was announced in the Official Gazette at 1421 O.G. 246, on December 29,
2015.

The Federal Service on Intellectual Property, Patents & Trademarks of
Russia as Searching and Examining Authority

   The Federal Service on Intellectual Property, Patents & Trademarks of
Russia (Rospatent) may act as the ISA or the IPEA for an international
application filed with the United States Receiving Office or the
International Bureau (IB) as Receiving Office where at least one of the
applicants is either a national or resident of the United States of
America. The announcement appears in the Official Gazette at 1378 O.G. 162,
on May 8, 2012.

   The search fee of Rospatent was changed, effective January 1, 2016,
and was announced in the Official Gazette at 1421 O.G. 246 on December 29,
2015.

Israel Patent Office as Searching and Examining Authority

   The Israel Patent Office (ILPO) may act as the ISA or the IPEA for an
international application filed with the United States Receiving Office
or the International Bureau (IB) as Receiving Office where at least one
of the applicants is either a national or resident of the United States
of America. The announcement appears in the Official Gazette at 1408 O.G.
52, on November 4, 2014. However, the use of the ILPO is restricted. The
ILPO will not act as an ISA for applications with one or more claims
relating to a business method as defined by certain International Patent
Classification classes nor will the ILPO act as an ISA where it has
received more than 75 international applications from the USPTO during a
fiscal quarter, as indicated in the Official Gazette at 1408 O.G. 52 on
November 4, 2014. For the definition of what the ILPO considers to be
precluded subject matter in the field of business methods, see Annex B of
the Agreement between the Israel Patent Office and the United States
Patent and Trademark Office
(http://www.uspto.gov/patents/law/notices/ilpo_isa-ipea.pdf). The ILPO
will act as an IPEA only if it also acted as the ISA.

   The search fee of ILPO was changed, effective January 1, 2016, and was
announced in the Official Gazette at 1421 O.G. 246 on December 29, 2015.

Japan Patent Office as Searching and Examining Authority

   The Japan Patent Office (JPO) may act as the ISA or the IPEA for an
international application filed with the United States Receiving Office or
the International Bureau (IB) as Receiving Office where at least one of the
applicants is either a national or resident of the United States of
America. The announcement appears in the Official Gazette at 1417 O.G. 63,
on August 4, 2015. However, the use of the JPO is restricted. The JPO will
act as an ISA for applications only where the claims of the application are
directed to the field of green technology as defined by certain
International Patent Classification classes and where the JPO has not
received more than 5,000 international applications from the USPTO during
the 3 year period from July 1, 2015 to June 30, 2018, and not more than 300
applications per quarter during the first year, and not more than 475
application per quarter during the second and third years, as indicated in
the Official Gazette at 1417 O.G. 63 on August 4, 2015. For the
definition of what the JPO considers to be the field of green technology,
see Annex A of the Agreement between the Japan Patent Office and the United
States Patent and Trademark Office at 1417 O.G. 67, August 4, 2015. The JPO
will act as an IPEA only if it also acted as the ISA.

   The search fee of the JPO was changed, effective January 1, 2016, and
was announced in the Official Gazette at 1421 O.G. 246 on December 29,
2015.

   The transmittal fee for the USPTO was changed to include a basic portion
and a non-electronic filing fee portion, effective November 15, 2011, and
was announced in the Federal Register on November 15, 2011. Search fees
for the USPTO were changed, effective January 12, 2009, and were announced
in the Federal Register on November 12, 2008. The fee for filing a request
for the restoration of the right of priority was established, effective
November 9, 2007, and was announced in the Federal Register on
September 10, 2007.

   International filing fees were changed, effective January 1, 2016,
and were announced in the Official Gazette at 1421 O.G. 246 on
December 29, 2015. The elimination of the discount for filing the
international application in paper with a PCT EASY zip file was announced
in the Official Gazette at 1419 O.G. 128 on October 20, 2015.

                  Notice of Maintenance Fees Payable

   Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides
that maintenance fees may be paid without surcharge for the six-month
period beginning 3, 7, and 11 years after the date of issue of patents
based on applications filed on or after Dec. 12, 1980. An additional
six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e)
for payment of the maintenance fee with the surcharge set forth in 37 CFR
1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is
not paid in the patent requiring such payment the patent will expire on
the 4th, 8th, or 12th anniversary of the grant.

   On December 22, 2015, at approximately 7:00 pm, the United States Patent
and Trademark Office (USPTO) experienced a major power outage at its
headquarters in Alexandria, Virginia, resulting in damaged equipment that
required the subsequent shutdown of many USPTO online and information
technology systems. The USPTO is currently estimating that these systems
will be impacted through at least the Federal holiday on Friday, December
25, 2015. In light of this emergency situation, the USPTO will consider
each day from Tuesday, December 22, 2015, through Thursday, December 24,
2015, to be a "Federal holiday within the District of Columbia" under
35 U.S.C. § 21 and 37 C.F.R. §§ 1.6, 1.7, 1.9, 2.2(d), 2.195, and 2.196.
Any action or fee due on these days will be considered as timely for the
purposes of, e.g., 15 U.S.C. §§ 1051(b), 1058, 1059, 1062(b), 1063, 1064,
and 1126(d), or 35 U.S.C. §§ 119, 120, 133, and 151, if the action is
taken, or the fee paid, on the next succeeding business day on which the
USPTO is open (37 C.F.R. §§ 1.7(a) and 2.196). A subsequent notice is
anticipated to be issued as needed if the USPTO's systems are not fully
operational by Monday, December 28, 2015.

   37 C.F.R. §§ 1.6(a)(2), 2.195(a)(4), and 2.198 provide that certain
correspondence deposited in the Priority Mail Express® service of the
United States Postal Service (USPS) in accordance with 37 C.F.R. §§ 1.10 or

AGENCY: United States Patent and Trademark Office, Commerce.

ACTION: Initiation of Pilot Program and Request for Program Topics.

SUMMARY: The United States Patent and Trademark Office (USPTO) is
initiating a new pilot program as part of its Enhanced Patent Quality
Initiative. Currently, the USPTO performs reviews of applications on
target issues for internal quality purposes, referred to as "case
studies." The USPTO now seeks to leverage the experience of its
stakeholders to expand the use of case studies to additional quality-
related topics. Beginning immediately, stakeholders are invited to
submit patent quality-related topics that they believe should be the
subject of a case study. After considering the submitted topics, the
USPTO will identify which topics will be the subject of upcoming case
studies. The USPTO anticipates that the results of these case studies
will help it to understand better the quality of its work products and,
where appropriate, to take action to remediate quality issues or to
formulate best practices to further enhance quality. Such public
engagement is sought not only to broaden the scope of quality issues

SUPPLEMENTARY INFORMATION:

I. The Enhanced Quality Initiative

   On February 5, 2015, the United States Patent and Trademark Office
(USPTO) launched an enhanced quality initiative to improve the quality
of patents issued by the USPTO. This initiative began with a request
for public comments on a set of six proposals outlined in a document in
the Federal Register, Request for Comments on Enhancing Patent Quality,
80 FR 6475 (Feb. 5, 2015). The USPTO also held a two-day "Quality
Summit" on March 25 and 26, 2015, at the USPTO headquarters in
Alexandria, Virginia, to discuss the quality concerns of patent
stakeholders and to receive feedback on the USPTO's proposals.
Following the Quality Summit, the USPTO has continued its engagement
with the public through numerous roadshows, events, and stakeholder
meetings to further refine the steps that may be taken to improve
quality.
   The enhanced patent quality initiative targets three pillars of
patent quality: (1) Excellence in work products; (2) excellence in
measuring patent quality; and (3) excellence in customer service. As
part of the first pillar, the USPTO is focusing on the quality of the
work products provided at every stage of the patent process, including
the actions taken by the USPTO during application processing,
examination, and issuance processes, as well as the quality of issued
patents. The USPTO originally proposed creating a mechanism by which
the public could flag particular applications to the Office of Patent
Quality Assurance (OPQA) for review. After considering the comments
from both our internal and external stakeholders, the USPTO decided to
revise its original proposal. The USPTO is, instead, implementing a
pilot program in which stakeholders are invited to submit patent
quality-related topics, not particular applications, they believe
should be the subject of a case study.

II. Case Studies at the USPTO

   The USPTO performs case studies to investigate specific quality-
related issues in addition to reviews of individual examiner work
products, such as its review of a sampling of first Office actions on
the merits. The USPTO designs, and performs, these case studies to
investigate whether the quality-related issues that are the subject of
these studies exist. If the result of a case study reveals that action
is needed, the USPTO takes the necessary action. For example, if the
result of the case study reveals that additional training is needed,
the USPTO develops and implements the training. Unlike the USPTO's
review of specific Office actions in an individual application, case
studies allow the USPTO to investigate how a particular issue is being
treated or addressed across hundreds or thousands of applications. The
USPTO historically has performed case studies for internal quality
purposes.

III. Topic Submission for Case Studies Pilot Program

   This new pilot program invites the public to submit topics for case
studies. Submissions may concern any topic affecting the USPTO's
ability to effectively issue high-quality patents. A submission should
be more than a mere statement of an issue or problem encountered by the
submitter. A submission should propose a specific correlation or trend
for study, and where possible, suggest a methodology for its
investigation. A helpful submission would also explain how the results
of that case study could be used to improve patent quality. The
submission may refer to concrete examples to support the proposed
correlation or trend, but any such examples should not contain
information sufficient to identify any particular application, any

particular examiner, or any particular art unit. A submission may
specify certain data subsets for analysis, e.g., primary vs. junior
examiners, or data broken out for each Technology Center. Finally, the
submission should identify any relevant dates of concern that pertain
to the issue presented, e.g., dates of a particular court opinion or
USPTO guidance document.
   The following restrictions are placed on submissions. First, each
separate topic must be presented in a separate submission to ensure
consideration, although there is no limit placed upon the number of
submissions from a person or entity. Second, each submission should be
titled, such as in an email's "subject" line, to reflect the topic
contained therein. Third, submissions should not contain information
associated with any particular patent application or patent, any
particular examiner, or any particular art unit; any such submission
will not be part of the study. Fourth, topics should focus on patent
quality issues; topics relating to other issues such as management
concerns or statutory changes are outside the scope of these case
studies. Fifth, the submission should concisely explain the nature and
purpose of the proposed study to aid the USPTO in selecting the best
topic(s) for this pilot program; the submission should not include
lengthy supporting documentation or arguments.
   The USPTO will consider these suggestions and identify potential
areas for quality case studies in addition to those already being conducted
by OPQA. The USPTO will use the results of the studies to improve its
understanding of the quality of its work products and, where
appropriate, to take action to remediate quality issues or to formulate
best practices to further enhance quality. For example, if a case study
reveals a training issue, the USPTO will develop and deliver the
appropriate training.
   This pilot program will help the USPTO determine the usefulness of
this manner of public submission for case study topics as compared to
currently-existing methods, such as public fora and external quality
surveys. In addition, this pilot program will allow the USPTO to
communicate to the public the case studies determined to be useful and
the results of those studies.

IV. Example of a Topic Submission

   The following example is provided to assist the public in providing
high-quality submissions that best communicate a focused case study
topic for consideration:
   Title: "Pre-first action interviews and quality of the resulting
patent prosecution."
   Proposal for study: "Pre-first action interviews result in a shorter
time-to-issuance in such applications that are issued as
patents."
   Explanation: In my experience as a patent practitioner, interviews
with examiners lead to better understanding of the claimed invention by
both parties. In particular, interviews can reveal that the parties are
operating under differing understandings of the scope of the claims,
the meaning of a claim term, or interpretation of a teaching of the
prior art. When performed early in prosecution, these can provide the
opportunity to resolve such differences before the mutual misunderstanding
or miscommunication results in extended prosecution. This permits more
efficient examination as reflected by a shorter prosecution time for those
applications that eventually mature into patents. These efficiency gains
are most noticeable after April 1, 2011, when the Full First Action
Interview Pilot Program went into effect. The USPTO should study what
effect an interview before the first action on the merits in a new
application has on time-to-allowance in applications that are eventually
issued as patents, and if there are any particular features of the
interview that strongly correlate with the time-to-allowance. Discovery of
such correlations could lead to USPTO process changes or changes in
applicants' approach to prosecution that could improve the overall
efficiency and effectiveness of patent prosecution.

SUMMARY: The United States Patent and Trademark Office (USPTO)
implemented a pilot program (Extended Missing Parts Pilot Program) in
which an applicant, under certain conditions, can request a 12-month
time period to pay the search fee, the examination fee, any excess
claim fees, and the surcharge (for the late submission of the search
fee and the examination fee) in a nonprovisional application. The
Extended Missing Parts Pilot Program benefits applicants by permitting
additional time to determine if patent protection should be sought - at
a relatively low cost - and by permitting applicants to focus efforts on
commercialization during this period. The Extended Missing Parts Pilot
Program benefits the USPTO and the public by adding publications to the
body of prior art, and by removing from the USPTO's workload those
nonprovisional applications for which applicants later decide not to
pursue examination. The USPTO is extending the Extended Missing Parts
Pilot Program until December 31, 2016, to allow for the USPTO to seek
public comment, via a subsequent notice to be published in the middle
of 2016, on whether the Extended Missing Parts Program offers
sufficient benefits to the patent community for it to be made
permanent. The requirements of the program have not changed.

DATES: Duration: The Extended Missing Parts Pilot Program will run
through December 31, 2016. Therefore, any certification and request to
participate in the Extended Missing Parts Pilot Program must be filed
on or before December 31, 2016. The USPTO may further extend the pilot
program (with or without modifications) depending on the feedback
received and the continued effectiveness of the pilot program.

written comments from the public, the USPTO changed the missing parts
examination procedures in certain nonprovisional applications by
implementing a pilot program (i.e., Extended Missing Parts Pilot
Program). See Pilot Program for Extended Time Period To Reply to a
Notice to File Missing Parts of Nonprovisional Application, 75 FR 76401
(Dec. 8, 2010), 1362 Off. Gaz. Pat. Office 44 (Jan. 4, 2011). The USPTO
has previously announced extensions of the Extended Missing Parts Pilot
Program through notices published in the Federal Register. See

(Dec. 16, 2011), 1374 Off. Gaz. Pat. Office 113 (Jan. 10, 2012);

on December 31, 2015.

   Through this notice, the USPTO is further extending the Extended
Missing Parts Pilot Program until December 31, 2016. The USPTO may
further extend the Extended Missing Parts Pilot Program, or may
discontinue the pilot program after December 31, 2016, depending on the
results of the program. The requirements of the program, which have not
been modified, are reiterated below. Applicants are strongly cautioned
to review the pilot program requirements before making a request to
participate in the Extended Missing Parts Pilot Program.
   The USPTO cautions all applicants that, in order to claim the
benefit of a prior provisional application, the statute requires a
nonprovisional application filed under 35 U.S.C. 111(a) to be filed
within 12 months after the date on which the corresponding provisional
application was filed. See 35 U.S.C. 119(e). It is essential that
applicants understand that the Extended Missing Parts Pilot Program
cannot and does not change this statutory requirement. Title II of the
Patent Law Treaties Implementation Act of 2012 (PLTIA) amended the
provisions of title 35, United States Code, including 35 U.S.C. 119(e),
to implement the Patent Law Treaty (PLT). See Public Law 112-211,
§§ 20-203, 126 Stat. 1527, 1533-37 (2012). In the rulemaking to
implement the PLT and title II of the PLTIA, the Office provided that
an applicant may file a petition under 37 CFR 1.78(b) to restore the
benefit of a provisional application filed up to fourteen months
earlier. See Changes To Implement the Patent Law Treaty, 78 FR 62367,
62368-69 (Oct. 21, 2013) (final rule). Any petition to restore the
benefit of a provisional application must include the benefit claim,
the petition fee, and a statement that the delay in filing the
subsequent application was unintentional. This change was effective on
December 18, 2013, and applies to any application filed before, on, or
after December 18, 2013. However, if a nonprovisional application is
filed outside the 12 month period from the date on which the corresponding
provisional application was filed, the nonprovisional application is
not eligible for participation in the Extended Missing Parts Pilot
Program, even though the applicant may be able to restore the benefit of
the provisional application by submitting a petition under 37 CFR 1.78(b).
   I. Requirements: In order for an applicant to be provided a 12-month
(non-extendable) time period to pay the search and examination fees and
any required excess claims fees in response to a Notice to File Missing
Parts of Nonprovisional Application under the Extended Missing Parts Pilot
Program, the applicant must satisfy the following conditions: (1) The
applicant must submit a certification and request to participate in the
Extended Missing Parts Pilot Program with the nonprovisional application on
filing, preferably by using Form PTO/AIA/421, titled "Certification and
Request for Extended Missing Parts Pilot Program"; (2) the application must
be an original (i.e., not a Reissue) nonprovisional utility or plant
application filed under 35 U.S.C. 111(a) within the duration of the pilot
program; (3) the nonprovisional application must directly claim the benefit
under 35 U.S.C. 119(e) and 37 CFR 1.78 of a prior provisional application
filed within the previous 12 months, and the specific reference to the
provisional application must be in an application data sheet under
37 CFR 1.76 (see 37 CFR 1.78(a)(3)); and (4) the applicant must not have
filed a nonpublication request.
   As required for all nonprovisional applications, the applicant will
need to satisfy filing date requirements and publication requirements.
In the rulemaking to implement the PLT and title II of the PLTIA, the
Office provided that an application (other than an application for a
design patent) filed on or after December 18, 2013, is not required to
include a claim to be entitled to a filing date. See Changes To
Implement the Patent Law Treaty, 78 FR 62367, 62638 (Oct. 21, 2013)
(final rule). This change was effective on December 18, 2013, and
applies to any application filed under 35 U.S.C. 111 on or after
December 18, 2013. However, if an application is filed without any
claims, the Office of Patent Application Processing will issue a notice
giving the applicant a two-month (extendable) time period within which
to submit at least one claim in order to avoid abandonment (see 37 CFR
1.53(f)). The Extended Missing Parts Pilot Program does not change this
time period. In accordance with 35 U.S.C. 122(b), the USPTO will

publish the application promptly after the expiration of 18 months from
the earliest filing date for which benefit is sought. Therefore, the
nonprovisional application should also be in condition for publication
as provided in 37 CFR 1.211(c). The following are required in order for
the nonprovisional application to be in condition for publication: (1)
The basic filing fee; (2) the executed inventor's oath or declaration
in compliance with 37 CFR 1.63 or an application data sheet containing
the information specified in 37 CFR 1.63(b); (3) a specification in
compliance with 37 CFR 1.52; (4) an abstract in compliance with 37 CFR
1.72(b); (5) drawings in compliance with 37 CFR 1.84 (if applicable);
(6) any application size fee required under 37 CFR 1.16(s); (7) any
English translation required by 37 CFR 1.52(d); and (8) a sequence
listing in compliance with 37 CFR 1.821-1.825 (if applicable). The
USPTO also requires any compact disc requirements to be satisfied and
an English translation of the provisional application to be filed in
the provisional application if the provisional application was filed in
a non-English language and a translation has not yet been filed. If the
requirements for publication are not met, the applicant will need to
satisfy the publication requirements within a two-month extendable time
period.
   As noted above, applicants should request participation in the
Extended Missing Parts Pilot Program by using Form PTO/AIA/421. For
utility patent applications, the applicant may file the application and
the certification and request electronically using the USPTO electronic
filing system, EFS-Web, and selecting the document description of
"Certification and Request for Missing Parts Pilot" for the
certification and request on the EFS-Web screen. Form PTO/AIA/421 is
available on the USPTO Web site at
http://www.uspto.gov/sites/default/files/forms/aia0421.pdf. Information
regarding EFS-Web is available on the USPTO Web site at
http://www.uspto.gov/patents-application-process/applying-online/about-efs-
web.
   The utility application including the certification and request to
participate in the pilot program may also be hand-carried to the USPTO
or filed by mail, for example, by Priority Mail Express® in
accordance with 37 CFR 1.10. However, applicants are advised that,
effective November 15, 2011, as provided in the Leahy-Smith America
Invents Act, a new additional fee of $400.00 for a non-small entity
($200.00 for a small entity) is due for any nonprovisional utility
patent application that is not filed by EFS-Web. See Public Law 112-29,
§ 10(h), 125 Stat. 283, 319 (2011). This non-electronic filing fee
is due on filing of the utility application or within the two-month
(extendable) time period to reply to the Notice to File Missing Parts
of Nonprovisional Application. Applicants will not be given the 12-
month time period to pay the non-electronic filing fee. Therefore,
utility applicants are strongly encouraged to file their utility
applications via EFS-Web to avoid this additional fee.
   For plant patent applications, the applicant must file the
application including the certification and request to participate in
the pilot program by mail or hand-carried to the USPTO since plant
patent applications cannot be filed electronically using EFS-Web. See
Legal Framework for Electronic Filing System - Web (EFS-Web), 74 FR
55200 (Oct. 27, 2009), 1348 Off. Gaz. Pat. Office 394 (Nov. 24, 2009).
   II. Processing of Requests: If the applicant satisfies the
requirements (discussed above) on filing of the nonprovisional
application and the application is in condition for publication, the
USPTO will send the applicant a Notice to File Missing Parts of
Nonprovisional Application that sets a 12-month (non-extendable) time
period to submit the search fee, the examination fee, any excess claims
fees (under 37 CFR 1.16(h)-(j)), and the surcharge under 37 CFR 1.16(f)
(for the late submission of the search fee and examination fee). The
12-month time period will run from the mailing date, or notification
date for e-Office Action participants, of the Notice to File Missing

the Notice to File Missing Parts within the 12-month time period and the
nonprovisional application is completed, the nonprovisional application
will be placed in the examination queue based on the actual filing date
of the nonprovisional application.

   III. Important Reminders: Applicants are reminded that the
disclosure of an invention in a provisional application should be as
complete as possible because the claimed subject matter in the later-
filed nonprovisional application must have support in the provisional
application in order for the applicant to obtain the benefit of the
filing date of the provisional application.
   Furthermore, the nonprovisional application as originally filed
must have a complete disclosure that complies with 35 U.S.C. 112(a) and
is sufficient to support the claims submitted on filing and any claims
submitted later during prosecution. New matter cannot be added to an
application after the filing date of the application. See 35 U.S.C.
132(a). In the rulemaking to implement the PLT and title II of the
PLTIA, the Office provided that, in order to be accorded a filing date,
a nonprovisional application (other than an application for a design
patent) must include a specification with or without claims. See
Changes To Implement the Patent Law Treaty, 78 FR 62367, 62369 (Oct.
21, 2013) (final rule). This change was effective on December 18, 2013,
and applies to any application filed under 35 U.S.C. 111 on or after
December 18, 2013. Although a claim is not required in a nonprovisional
application (other than an application for a design patent) for filing
date purposes and the applicant may file an amendment adding additional
claims as prescribed by 35 U.S.C. 112 and drawings as prescribed by 35
U.S.C. 113 later during prosecution, the applicant should consider the
benefits of submitting a complete set of claims and any necessary
drawings on filing of the nonprovisional application. This would reduce
the likelihood that any claims and/or drawings added later during
prosecution might be found to contain new matter. Also, if a patent is
granted and the patentee is successful in litigation against an
infringer, provisional rights to a reasonable royalty under 35 U.S.C.
154(d) may be available only if the claims that are published in the
patent application publication are substantially identical to the
patented claims that are infringed, assuming timely actual notice is
provided. Thus, the importance of the claims that are included in the
patent application publication should not be overlooked.
   Applicants are also advised that the extended missing parts period
does not affect the 12-month priority period provided by the Paris
Convention for the Protection of Industrial Property (Paris
Convention). Accordingly, any foreign filings must, in most cases,
still be made within 12 months of the filing date of the provisional
application if the applicant wishes to rely on the provisional
application in the foreign-filed application or if protection is
desired in a country requiring filing within 12 months of the earliest
application for which rights are left outstanding in order to be
entitled to priority.
