(407)Intent to Publish Corrected Publications for Patent Applications
Published on April 25, 2024, that Contained Incorrect Filing Dates and/or
                              Benefit Dates

Summary

   The United States Patent and Trademark Office (USPTO) is publishing
corrected patent application publications for patent applications published
on April 25, 2024, that contained errors in the filing date and/or benefit
date(s). No action is required from the affected patent applicants.

Details

   With certain exceptions, the USPTO promptly publishes nonprovisional
utility and plant applications after the expiration of a period of 18
months from the earliest filing date for which a benefit is sought under
35 U.S.C. 119, 120, 121, 365, or 386 (pre-grant publications). See
35 U.S.C. 122(b). The pre-grant publications include actual filing dates of
the applications and any earlier filing dates for which a benefit is
sought.

   Pre-grant publications published on April 25, 2024, included errors in
the filing date and/or benefit date(s). The errors occurred during initial
data assembly and export in the publication process. The USPTO has made the
appropriate system corrections to address these errors in filing date
and/or benefit date, and pre-grant publications published after the system
corrections will not include incorrect filing date and/or benefit date(s)
caused by the system errors that resulted in the incorrect April 25, 2024,
publications.

   The USPTO considers the filing date and benefit date(s) of an
application to be material for examination. Therefore, the USPTO considers
the publication errors on April 25, 2024, as grounds for corrected patent
application publications in accordance with 37 CFR 1.221(b).

   The USPTO will, on its own initiative, send a "Notice of Acceptance of
Publication Request" in the affected applications. The publications for the
affected applications will be republished in due course as corrected patent
application publications to include the correct filing date and/or benefit
date(s). Corrected patent application publications have a label "A9"
(Patent Application Publication (Corrected Publication)) adjacent the
publication number. No action is required from the affected patent
applicants.
