USPTO announces comment request and roundtable discussion on e-commerce guidelines

Federal Register Notice outlines comment process; roundtable to be held June 5, 2025

The U.S. Patent and Trademark Office (USPTO) has issued a Federal Register Notice (FRN) requesting written public comments on the Organization for Economic Cooperation and Development’s (OECD) “Draft Voluntary Guidelines for Countering Illicit Trade in Counterfeit Goods on Online Marketplaces.”

The guidelines are being developed to provide OECD member countries (including the United States), online marketplace operators, and intellectual property (IP) rights holders with insights and best practices for local economies to enhance enforcement against counterfeit products found on online marketplaces. To obtain a copy of the OECD guidelines, please email your request to enforcement@uspto.gov.

A public roundtable will take place on June 5, 2025. It will focus on stakeholders’ assessment of the OECD’s draft guidelines. The roundtable will be held at the OECD Washington Center located in Washington, D.C., with the option for virtual attendance. In-person registration closes on May 29, 2025. The USPTO is also requesting written comments on OECD’s draft guidelines. The FRN outlines the comment process and provides a list of addressable topics for respondents. The submission deadline for comments is June 27, 2025, at 11:59 p.m. ET.
